DEPARTMENTAL RECOMMENDATION:
The Department of Resource Management recommends that the Board approve setting a public hearing on July 23, 2019 at 2:00 PM to consider an appeal of the Planning Commission’s denial of Administrative Permit Application No. AD-18-02 for Leeanna Ellis to have a special events facility for up to 6 events per year with up to 150 attendees at 5580 Nicholas Lane, Dixon in an Exclusive Agricultural “A-40” Zoning District, APN: 0141-090-250.
SUMMARY/ DISCUSSION:
On May 16, 2019 the Solano County Planning Commission held a public hearing to consider an appeal of the Director of Resource Management’s denial of Administrative Permit Application No. AD-18-02. After closing the public hearing and considering all comments regarding said application, the Planning Commission voted 5-0, to deny the appeal and affirm the Director of Resource Management’s decision denying Administrative Permit No. AD-18-02. The applicant subsequently filed an appeal to the Planning Commission’s denial with the Clerk of the Board on May 24, 2019, which is within the 10-day time period to file appeals to the Board per Solano County Code, section 28-112(e). Pursuant to Solano County Code, section 28-112(e), the Board must also hear the appeal within thirty-five days of today’s Board meeting, or more specifically, on or before July 30, 2019. The Department recommends that July 23, 2019 at 2:00 pm be set as the date and time for the public hearing to consider the appeal since it falls within the time period prescribed by County Code to hear the appeal and is the next regularly scheduled Board meeting. If this hearing date is approved, the Department will provide the required notice of the hearing.
FINANCIAL IMPACT:
Costs associated with Administrative Permit No. 18-02 have been paid by the applicant, and the cost associated with filing an appeal of said permit to the Board has been paid by the appellant. The costs associated with preparing the agenda item are nominal and absorbed by the department’s FY2018/19 Adopted Budget.
ALTERNATIVES:
The Board may set an alternative date and time in order to conduct the public hearing on the appeal but must hold the hearing on or before July 30, 2019.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed this item. The Planning Commission heard the appeal on May 16, 2019 and rendered their decision to affirm the Director of Resource Management’s decision to deny the administrative permit application.
