DEPARTMENTAL RECOMMENDATION:
The Sheriff recommends that the Board of Supervisors:
1. Approve a Grant Property Transfer Agreement with the City and County of San Francisco’s Department of Emergency Management to accept the transfer of a multi-gas detector purchased with Department of Homeland Security Urban Areas Security Initiative funds by the Bay Area Urban Areas Security Initiative Group;
2. Approve a second Grant Property Transfer Agreement, pending County Counsel concurrence, with the Department of Emergency Management to accept the transfer of a spectrometer chemical detection device;
3. Delegate authority to the Sheriff, Undersheriff, and Solano County’s Emergency Services Manager to execute both agreements; and
4. Approve an Appropriation Transfer Request of $96,600 to increase appropriations to record the equipment transfer based on the purchase price of the equipment and recognize unanticipated donation revenue (4/5 vote required).
SUMMARY/DISCUSSION:
The City and County of San Francisco (San Francisco), as the fiscal agency overseeing the Bay Area Urban Areas Security Initiative Group administering the San Francisco, San Jose and Oakland Urban Area Security Initiative (UASI) has offered hazardous materials detection equipment to Solano County. This equipment will be donated in two phases with the first donation of a multi-gas detector. The Grant Property Transfer Agreement includes the multi-gas pumped detector, an extendable sampling probe, and a recharging docking station newly purchased by the Bay Area UASI Group using UASI funds to enhance security in the region.
The second grant property transfer agreement between Solano County and the Department of Emergency Management on behalf of the Bay Area UASI Group will need to be executed in order to receive a spectrometer chemical detection device.
The Solano Operational Area is an active partner in the Bay Area UASI Northbay Hub. Once all the components of the equipment are received, it will be issued to the Solano County Interagency Hazardous Materials Team to be used during response to Hazardous Materials incidents within the operational area and be made available for mutual aid deployment.
FINANCIAL IMPACT:
After consultation with Purchasing and the Auditor-Controller’s Office, the equipment transfers will be treated as donated equipment, and in accordance with generally accepted accounting principles, the equipment will be recorded at the purchase price and/or fair market value at the time of transfer. The HazMat FY2025/26 Working Budget does not include sufficient appropriations; therefore, an Appropriation Transfer Request is necessary to record the donated equipment. Board action will not impact the County General Fund.
Under these two Agreements, the Sheriff’s Office is and will be responsible for the maintenance and repair of the grant equipment and damages to the equipment which occur while the property is in the possession of Solano County. The maintenance costs will be absorbed within the HazMat Budget. The Sheriff’s Office will perform periodic physical inventories of grant equipment as required by the grant.
The costs associated with preparing this agenda item are nominal and absorbed by the department’s FY2025/26 Working Budget.
ALTERNATIVES:
The Board can choose not to accept the equipment; however, this alternative is not recommended as non-acceptance may negatively impact the County’s capability to effectively respond to hazardous materials incidents. Additionally, this alternative is not fiscally prudent as this equipment would be redistributed to other counties, and the Sheriff’s Office does not have sufficient appropriation to purchase the equipment.
OTHER AGENCY INVOLVEMENT:
The City and County of San Francisco prepared the Grant Property Transfer Agreement, which has been reviewed and approved by County Counsel. Purchasing and the Auditor-Controller’s Office were consulted regarding recording the donated equipment transfer.
