DEPARTMENTAL RECOMMENDATION:
The Department of Resource Management (Department) recommends that the Board of Supervisors:
1) Adopt a resolution to summarily vacate a portion of Midway Road (County Road No. 152) East of Interstate 80;
2) Adopt a resolution to accept a Dedication of Public Right-of-Way; and
3) Conduct a Public Hearing to consider adopting a resolution of intent to name “Sodhi Circle” for the proposed public road.
SUMMARY:
On August 21, 2025, following a noticed public hearing, the Planning Commission approved the Midway Plaza Use Permit to develop a truck and automobile fueling/service station, convenience store, and two quick service restaurants, located at the northeast corner of Midway Road and Lewis Road, adjacent to the City of Vacaville.
As part of the Midway Plaza Project approved under Use Permit U-20-03, the owner has petitioned the County to summarily vacate a portion of the public right-of-way known as Midway Road (County Road No. 152). The portion of the public right-of-way to be vacated is the dead-end, unmaintained segment located east of the existing traveled way of Midway Road. This right-of-way is 50 feet in width, approximately 800 feet in length and encompasses an area approximately 1.4 acres which is located immediately east of Interstate 80, north of the connection to Lewis Road (Attachment A).
Streets and Highways Code section 8334 authorizes the County to summarily vacate excess right-of-way that is not required for street or highway purposes. The subject segment of Midway Road meets these criteria. The Resolution to Summarily Vacate (Attachment B) states that the proposed vacation is consistent with the General Plan and authorizes the vacation of the unused public right-of-way and authorizes the County Surveyor to process and record the documents necessary to complete the vacation. As part of the project under the approved Use Permit, the applicant intends to dedicate public right-of-way and construct a new public road to connect the facility to Midway Road and Lewis Road (Attachment A). The proposed dedication of public right-of-way is 60 feet wide and encompasses approximately one acre. The applicant has proposed the new public road to be named as “Sodhi Circle”. Solano County Code, Chapter 30 requires the Board of Supervisors adopt a resolution to authorize the naming of a Public Road. The Resolution to Accept Public Right-of-Way (Attachment C) authorizes the County Surveyor to accept and record the necessary documents for the new public right-of-way and approves the proposed road name, as presented by the applicant.
Pursuant to Streets and Highways Code section 941(b), the County will accept the dedication of the proposed public right-of-way but will not accept the roadway into the County-maintained Road System at this time. The Department will defer acceptance of the roadway into the County’s maintained mileage until the Developer has obtained the necessary permits and constructed the roadway in compliance with the Solano County Road Improvement Standards and Land Development Requirements.
FINANCIAL IMPACT:
The applicant has paid all costs associated with the Application to Summarily Vacate a portion of public right-of-way. The right-of-way is not currently maintained by the County and this application has no impact on the General Fund. The costs associated with constructing the future roadway improvements will be borne by the applicant.
The costs associated with preparing and processing the agenda item are nominal and absorbed by the Department’s FY2026/27 Working Budget.
DISCUSSION:
Pursuant to Streets and Highway Code section 8300 et seq., the County must make specified findings, conduct a public hearing, and complete required noticing before vacating the public right-of-way. The Department provided the required notice to property owners along the proposed road in accordance with Chapter 30, and noticed the right-of-way vacation in the local newspaper (Attachment D).
The dedication of the new, proposed public right-of-way will allow for the necessary realignment to serve the final design of the Midway project. The proposed right-of-way will provide safety enhancements and improvement opportunities for the County’s Road System associated with this development. The applicant will be required to obtain the necessary permits with the Department during the development of the proposed right-of-way in accordance with the Solano County Road Improvement Standards and Land Development Requirements. After the Department has inspected and accepted the constructed road, the County will then consider accepting the new right-of-way into the County’s Road System, thereby adding the roadway to the County’s maintained mileage.
County Code Chapter 30-30 allows an applicant to propose the name of the new right-of-way under consideration. Although public roads are typically classified as “street” or “road”, County Code Chapter 30-30 (g) allows for road naming exceptions where general naming integrity is otherwise preserved and name confusion is not likely to result. Public Works recommends the use of “circle” to best align with the future road’s configuration.
ALTERNATIVES:
The Board of Supervisors may choose to reject the proposed summary vacation and proposed right-of-way dedication; however, this is not recommended as this proposal will allow for the realignment of the abandoned spur and complement the proposed development. Additionally, the Board of Supervisors also may choose to reject the proposed road name and select an alternative name; however, this is not recommended as the Department has vetted the proposed name.
OTHER AGENCY INVOLVEMENT:
The affected public utility agencies (PG&E, SID, SCWA) have reviewed and approved the abandonment.
