RECOMMENDATION:
The Department of Resource Management recommends the Planning Commission:
1. Conduct a noticed public hearing; and
2. Adopt a resolution to approve Lot Line Adjustment application LLA-25-07 subject to the findings and conditions of approval contained in Attachment A
SUMMARY:
John Ott and the Annette L. Porini Family Trust (Porini) and the Schilling Grace Family Trust (Schilling) propose to adjust the common property line between two existing parcels located near Stevenson Bridge along Putah Creek at the Solano County line.
The adjustment will transfer 1.12 acres from Schilling to Porini to accommodate future building construction.
Under the Subdivision Map Act and Solano County Subdivision Ordinance the existing 2.98-acre Porini property and the 14.60-acre Schilling property are considered legal lots pursuant to Certificate of Compliance CC-91-17 recorded October 25, 1991.
Both lots are zoned Exclusive Agriculture “A-40” and in their existing configuration considered nonconforming with respect to the 40-acre district minimum parcel size. The transfer will increase the size of the smaller Porini lot.
Pursuant to Government Code §51257(a) and the Solano County Uniform Rules and Procedures Governing Agricultural Preserves and Land Conservation Contracts (Uniform Rules), Planning Commission approval is required for a lot line adjustment involving parcels under a single land conservation contract and which would not alter the outer perimeter of the land subject to that contract. Both properties are under a single land conservation contract, Williamson Act contract No. 297. The proposal does not alter contract boundaries and does not require replacement contracts.
DISCUSSION:

The Porini lot (APN 0107-030-160) is developed with a primary residence and associated utilities including domestic water well and private septic system. Access is provided via private driveway and by encroachment to Stevenson Bridge Road (County Road No. 143). The adjustment will increase the area around the residence on this property.
The Schilling lot (APN 0107-030-170) is developed with a primary residence, accessory barn and associated utilities including domestic water well and private septic system. Access is provided via private driveway off Strathgordon Lane, a private road.
CONSISTENCY ANALYSIS:
General Plan and Zoning
The subject properties are in the northeastern corner of the County identified as the Dixon Ridge agricultural region by the General Plan, as such both are designated Agriculture. A majority of the region is in the production of field crops. As seen on Table LU-7 of the General Plan, General Plan/Zoning Consistency Table, the Exclusive Agriculture “A-40” Zoning is consistent with these use designations.
Subdivision Ordinance
The applicant has supplied adequate information to accompany the lot line adjustment application per County Subdivision Ordinance Section 26-41.1. The proposal is consistent with allowable land uses and development standards of the A-40 Zoning district. The proposal involves the reconfiguration of two legal lots, and no new lots would be created.
To finalize the lot line adjustment, the applicants shall secure a signed Tax Certificate letter from the Solano County Tax Collector. Details regarding the Tax Certificate process are described in Condition of Approval No. 2. This step also enables the Certificate of Compliance process which ultimately memorializes an approved lot line adjustment.
Land Conservation Contract
The Williamson Act is a state program that provides a preferential tax advantage to a property owner in exchange for a commitment by the owner to maintain the property in commercial agricultural use. The County has established its Uniform Rules and Procedures to provide local procedures for how the program is to be implemented. The Uniform Rules and Procedures stipulate the procedure for processing lot line adjustments for contracted land, outline specific findings that must be made, and establishes minimum parcel size.
On May 14th, 1969, the Board of Supervisors adopted a resolution to enter into Williamson Act contract No. 297 with the property owner(s) of the subject site. The entire acreage of both parcels (17.58 acres) are entered into contract. When the contract was established, is was acknowledged that approximately 4.87 acres are encumbered by Putah Creek. The balance of the property (12.71 acres) is considered Prime Farmland and exceeds the 10-acres necessary to sustain their agricultural use.
The existing and reconfigured Porini property do not meet the 10-acre minimum parcel size for parcels under contract on Prime Farmland. As such, the property owner has agreed to enter into nonrenewal upon completion of the lot line adjustment. This will occur concurrently with the recordation of the Certificate of Compliance to finalize the lot line adjustment.
The lot line adjustment involves parcels under a single land conservation and will not alter the outer perimeter of contracted land, therefore no replacement contract is required. A majority of the site has been utilized for almond orchard and row crop production.
The proposed lot line adjustment is consistent with the California Land Conservation Act (Williamson Act) and the County’s Uniform Rules.
Environmental Review (CEQA)
Lot line adjustments are ministerial projects; therefore, are not held to the provisions and requirements of the California Environmental Quality Act (CEQA) per PRC Section 21080(b)(1).
OTHER AGENCY INVOLVEMENT:
The application has been reviewed by the Department of Resource Management’s Development Review Committee (DRC) meeting of October 8, 2025. Applicable conditions of approval have been incorporated into the attached resolution.
