DEPARTMENTAL RECOMMENDATION:
The Department of Human Resources recommends that the Board of Supervisors:
1. Adopt a resolution amending the List of Numbers and Classifications of Positions to add 1.0 FTE Chief Deputy County Counsel and delete 1.0 FTE Chief Deputy County Counsel (TBD) in the County Counsel’s Office subject to the Board of Supervisors’ approval of the FY2025/26 Midyear Financial Report Attachment G; and
2. Adopt a resolution amending the Alphabetical Listing of Classes and Salaries to add the classification of Chief Deputy County Counsel with a monthly salary range of $19,186.75 - $23,321.62.
SUMMARY/DISCUSSION:
The County Counsel’s Office provides legal advice and representation to the Board of Supervisors, County departments, boards and commissions, and other County agencies on a wide range of civil and administrative matters.
In the FY2025/26 Midyear Financial Report, the County Counsel’s Office has requested to modify its management structure to improve the distribution of supervisory and administrative responsibilities within the department by adding a 1.0 FTE Chief Deputy County Counsel (TBD). Historically, the Office has included a single Assistant County Counsel position responsible for overseeing many of the Office’s operational and supervisory functions. Following the appointment of a new County Counsel and the resulting vacancy in the Assistant County Counsel position, the Office reviewed its current organizational structure and identified an opportunity to better align management responsibilities with the Office’s workload and staffing needs, as well as the breadth and complexity of its services. The proposed reorganization introduces a Chief Deputy County Counsel classification to assist the County Counsel with day-to-day operational oversight and supervision of major functional areas of the Office. The Chief Deputy County Counsel will help coordinate legal services to County departments, supervise assigned attorneys, and assist in implementing departmental policies and priorities.
The proposed classification was reviewed through the County’s classification process and determined to appropriately reflect the level of supervisory and operational responsibilities associated with the role.
FINANCIAL IMPACT:
As part of the Midyear Financial Report, the County Counsel’s Office proposes deleting one Deputy County Counsel V position to partially offset the addition of the new classification. In addition, the Assistant County Counsel position will remain in the organizational structure but will be underfilled with the new Chief Deputy County Counsel classification to support the revised management structure. The increase in cost for the remainder of FY2025/26 is estimated at $8,271 and will be absorbed through salary savings due to the current vacancy. The ongoing increase in the annual salary is estimated at $33,084 and will be recovered through the countywide Cost Allocation Plan and from direct billings.
ALTERNATIVES:
The Board could choose not to adopt the recommended resolutions or modify the recommendations; however, doing so would limit the County Counsel’s Office ability to implement the proposed management structure intended to improve supervision, operational efficiency, and executive oversight of the Office’s legal functions.
OTHER AGENCY INVOLVEMENT:
The County Counsel’s Office and the County Administrator’s Office were consulted in the preparation of the recommendations.
