DEPARTMENTAL RECOMMENDATION:

 

The Director of Human Resources recommends that the Board of Supervisors:

 

1.                     Adopt a resolution accepting the Tentative Agreement with the Union of American Physicians and Dentists, regarding Unit 11 for a successor Memorandum of Understanding for the term August 25, 2026, through September 30, 2028; and

 

2.                     Approve a Side Letter Agreement to the Memorandum of Understanding to be entered into with the Union of American Physicians and Dentists regarding Unit 11 concerning Base Wage Increase Re-opener; and

 

3.                     Direct the Director of Human Resources to prepare the Memorandum of Understanding consistent with the Tentative Agreement and obtain the signatures of the appropriate Union of American Physicians and Dentists representatives; and

 

4.                     Delegate authority to the County Administrator or Director of Human Resources to execute the final Memorandum of Understanding and Side Letter Agreement and make technical, non-substantive adjustments.

 

SUMMARY:

 

Solano County and the Union of American Physicians and Dentists (UAPD), representing Bargaining Unit 11, have met and conferred in good faith regarding a successor collective bargaining Memorandum of Understanding (MOU) to replace the previous MOU which expired October 25, 2025. The representatives for the parties have reached a total tentative agreement for a successor MOU to be effective August 25, 2026, through September 30, 2028, upon approval by the Board of Supervisors. The membership of Unit 11 has ratified the terms of the tentative agreements.

 

The parties also reached agreement on a Side Letter providing for a limited reopener regarding the Year Three base wage adjustment.

 

FINANCIAL IMPACT:

 

Adoption of the new collective bargaining agreement for Unit 11 is projected to increase payroll costs by a total of $1,348,745 through September 30, 2028. Of this total cost, $432,810 is during FY2026/27, $749,148 is during FY 2027/28, and $166,787 is during FY2028/29.

 

The costs associated with preparing the agenda item are nominal and absorbed by the Department’s FY2026/27 Working Budget.

 

DISCUSSION:

 

Representatives of the County and UAPD have met and conferred in good faith regarding wages, hours, and other terms and conditions of employment.

 

The representatives of the parties have reached tentative agreements on the following changes for Unit 11:

 

1.                     Term of Agreement: The collective bargaining agreement will be effective August 25, 2026, through September 30, 2028.

 

2.                     Wages: Effective August 30, 2026, represented employees will receive a 3% base wage increase. Concurrently with the wage increase, active employees will receive a one-time lump sum payment of $1,200. Part-time employees receive a prorated amount based on their full-time equivalence.

 

Effective October 25, 2026, represented employees will receive a 2% base wage increase. Concurrently with the wage increase, active employees will receive a one-time lump sum payment of $500. Part-time employees will receive a prorated amount based on their full-time equivalence.

 

Effective July 4, 2027, represented employees will receive a 1% base wage increase.

 

3.                     Health Insurance/Cafeteria Plan: The County provides health insurance through CalPERS’ Public Employees’ Medical and Hospital Care Act (PEMHCA, or PERS Health Program). The County’s maximum premium contribution for health insurance/cafeteria plan will be set at 80% of the PEMHCA Region 1 Kaiser Permanente family rate minus the PEMHCA MEC for the 2026, 2027, and 2028 benefit rates, effective August 25, 2026. The County will contribute $50.00 per month into the Cafeteria Plan for employees who elect employee plus two or more dependents, effective the month of August 2026; this provision will sunset at the end of the pay period which includes the expiration of the 2026-2028 collective bargaining agreement.

 

4.                     Other Items: 

                     Updated observed holiday section to incorporate ½ holidays on Christmas Eve and New Year’s Eve into regular listing of holidays; added one paid floating holiday for a total of two in each calendar year.

                     Increased the annual cash payment for continuing education to $4,000. 

                     Increased bilingual pay to $80.00 per pay period.

                     Increased maximum vacation accrual cap by forty hours. 

                     Proposed Side Letter - the representatives of the parties reached tentative agreement to allow for reopening of negotiations on the “Year Three” base wage rate increase, solely for the limited purpose of discussing potential modification to the year three base wage rate increase, if any.

                     Updated Bereavement Leave section to add grandparents to qualifying family members and revised reproductive loss leave to provide for a maximum of 24 hours of leave. Bereavement leave must be taken within six months following the loss.

                     Continued Side Letter for CMSP Student Loan Program.

                     Continued Side Letter for Allowance for Part-time Employees to work above allocated hours.

                     Continued Side Letter to provide Recruitment/Retention Stipend should a new funding contract with Partnership Health Plan be implemented.

                     Continued Side Letter for Student Loan Repayment Program.

                     Updated contracting out language to reflect Assembly Bill (AB) 339 and provide for annual reporting of County service contracts.

 

County staff and labor representatives are in the process of preparing the written successor MOU to reflect the approved Tentative Agreement. Delegating authority to the County Administrator or Director of Human Resources to execute the final MOU will allow timely implementation once the document is complete, without requiring additional Board action as long as the final MOU is consistent with the terms approved in the attached Tentative Agreement. If any conflict exist between the terms contained in this staff report and the attached Tentative Agreement, the Tentative Agreement shall control.

 

ALTERNATIVES:

 

The Board could elect not to adopt the resolution accepting the Tentative Agreement with Unit 11; however, this is not recommended. The County and UAPD have met and conferred in good faith pursuant to the Meyers-Milias-Brown Act and reached tentative agreement within the parameters previously provided by the Board to its negotiation team. In addition, employees represented by UAPD have ratified the terms of the Tentative Agreement.

 

OTHER AGENCY INVOLVEMENT:

 

Negotiations for the successor collective bargaining agreement were conducted collaboratively by HR, the County Administrator’s Office, applicable County Departments, the Auditor-Controller’s Office, County Counsel, and representatives of UAPD Unit 11.

 

CAO RECOMMENDATION:

 

APPROVE DEPARTMENTAL RECOMMENDATION
