DEPARTMENTAL RECOMMENDATION:
The Department of Resource Management recommends that the Board of Supervisors:
1. Conduct the public hearing opened February 1, 2022 and continued to February 8, 2022 to consider Zone Text Amendment No. ZT-21-03;
2. Read the proposed ordinance by title only and waive further reading by majority vote;
3. Adopt the proposed ordinance for Zone Text Amendment No. ZT-21-03 amending Chapter 28 (Zoning Regulations) of the Solano County Code to revise the requirements for certain commercial uses.
SUMMARY/DISCUSSION:
On February 1, 2022, the Board of Supervisors opened the public hearing to consider this item; however, due to public input requesting additional time to review the zone text amendments related to agricultural, the item was continued to allow for a bifurcation of the proposed revisions and to allow for the highway commercial use changes to move forward separately. Board directed staff to meet with the agricultural community to discuss their concerns and report back on a proposed timeline on when a revised ordinance on the agricultural definitions and requirements will be returned to the Board for consideration and adoption. The attached ordinance and table (Attachments A and B) include proposed changes to certain commercial districts, including the Highway Commercial (C-H) District, to reflect land uses which typically are in those zoning districts. The proposed changes update the description of permitted land uses, eliminate several outdated land use categories, and reflect the current market conditions for the types of land uses, including those which are seeking proximity to highways.
FINANCIAL IMPACT:
The costs for preparation of the ordinance for the zoning text amendment are included in the Department of Resource Management’s FY 2021/22 Adopted Budget.
ALTERNATIVES:
The Board could choose not to adopt the proposed modified ordinance; however, this is not recommended since the proposed changes are ministerial in nature and provide technical clarifications for the Commercial Districts. The Board could choose to modify the ordinance. This is at the Board’s discretion.
OTHER AGENCY INVOLVEMENT:
County Counsel assisted in the development of the revised ordinance.
