DEPARTMENTAL RECOMMENDATION:

 

The Department of Human Resources (Department) recommends the Board of Supervisors approve and adopt the Listings of Classes and Salaries/Alphabetical by Class Title schedules produced during calendar year 2024 to meet the California Public Employees’ Retirement System (CalPERS) requirements of California Government Code § 20636 (b)(1) and California Code of Regulations (CCR), Title 2, § 570.5.

 

SUMMARY:

 

Solano County contracts with CalPERS to provide retirement pensions to its retirees which requires the County to adhere to statutory and regulatory requirements pertaining to public agencies.  CalPERS requires that only compensation earned as defined in California Government Code § 20636 can be reported to CalPERS and considered in calculating retirement benefits.  In order to determine the amount of compensation earnable, a member’s pay rate is limited to the amount identified on a publicly available pay schedule. The Department is seeking the Board’s approval of the Listings of Classes and Salaries/Alphabetical by Class Title schedules that were produced during calendar year 2024 (incorporated as Exhibits 1 through 6 for reference).

 

FINANCIAL IMPACT:

 

This proposed action does not have any financial impact on the County; the County already makes regular payments to CalPERS to fund retirement benefits for its employees based on Board-allocated positions and approved salary ranges.

 

The costs associated with preparing the agenda item are nominal and absorbed by the Department’s FY2024/25 Working Budget.

 

DISCUSSION:

 

CalPERS requires all contracting agencies have publicly available pay schedules for all job classifications, including appointed and elected positions, that are independent from the Memoranda of Understanding (MOUs) or Personnel and Salary Resolution (PSR).  CCR, Title 2, § 570.5 outlines the requirements to satisfy CalPERS’ definition of publicly available pay schedules as follows:

 

(1)                     Has been duly approved and adopted by the employer’s governing body in accordance with requirements of applicable public meeting laws;

(2)                     Identifies the position title for every employee position;

(3)                     Shows the payrate for each identified position, which may be stated as a single amount or as multiple amounts within a range;

(4)                     Indicates the time base, including, but not limited to, whether the time base is hourly, daily, bi-weekly, monthly, bi-monthly, or annually;

(5)                     Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer’s internet website;

(6)                     Indicates an effective date and date of any revisions;

(7)                     Is retained by the employer and available for public inspection for not less than five years; and

(8)                     Does not reference another document in lieu of disclosing the payrate.

 

Although all the salary changes incorporated on the salary schedules have already been approved by the Board through stand-alone agenda items or Ordinance, CalPERS requires the Board also approve the salary schedules during a public meeting.

 

ALTERNATIVES:

 

The Board of Supervisors could choose not to approve the Listings of Classes and Salaries/Alphabetical by Class Title schedules; however, staff does not recommend this alternative since CalPERS could limit retirement pension payments for retirees to the salary that was last published and approved in the retiree’s applicable MOU.
