DEPARTMENTAL RECOMMENDATION:
The Clerk of the Board recommends the Board adopt a resolution reappointing Kurt Balasek, Paul Lum, and Randi Thompson as Directors of the Solano Resource Conservation District (District), for the term November 30, 2024, through November 24, 2028, and appointing Chris Garcia to fill an unexpired term of January 7, 2025, through November 26, 2026.
SUMMARY/DISCUSSION:
Resource conservation districts are governed by boards of directors, which are composed of landowners in the district or their representatives. The directors’ terms commence at noon on the last Friday in November following their appointment. Public Resources Code section 9352 provides that directors of resource conservation districts must either (1) own real property in the district or alternatively have served two years or more as an associate director, or (2) be a designated agent of the landowner in the district.
As an alternative to conducting elections and as authorized by Public Resources Code section 9314 (b) and the District’s Resolution No. 02-103, the Board of Supervisors fills the expired terms on the Board of Directors by appointment.
The District posted a vacancy notice in accordance with the requirements of Government Code section 54974. In response to the notice, Kurt Balasek, Paul Lum, Randi Thompson, and Chris Garcia submitted the attached applications. The District received no other applications.
It is recommended that the Board of Supervisors accept the applications and reappoint Kurt Balasek, Paul Lum, and Randi Thompson with terms to expire November 24, 2028, and appoint Chris Garcia to fill an unexpired term through November 26, 2026.
FINANCIAL IMPACT:
There is no fiscal impact associated with the appointments.
ALTERNATIVES:
The Board of Supervisors could elect not to appoint the applicants to the Board of Directors for the Solano Resource Conservation District. However, this alternative is not recommended as the four applicants are the only qualified landowners to submit applications.
OTHER AGENCY INVOLVEMENT:
The Solano Resource Conservation District disseminated application packets and application information on request, posted the notice of vacancy and forwarded the application materials to the Board of Supervisors.
