DEPARTMENTAL RECOMMENDATION:

 

The Department of Resource Management recommends that the Board of Supervisors:

 

1.                     Conduct a public hearing to consider a report of delinquent solid waste service charges that are at least 60 days past due for services provided in the unincorporated area by Recology Vacaville Solano; Recology Vallejo; Rio Vista Sanitation Service dba Mt. Diablo Resource Recovery; and Solano Garbage Company dba Republic Services;

 

2.                     Hear and consider any objections or protests to the report of delinquent accounts;

 

3.                     Make appropriate revisions or corrections to the report of delinquent accounts;

 

4.                     Adopt resolutions contained in Attachments A through D, one for each of the four contractors, to:

 

a)                     Confirm the report of delinquent accounts;

b)                     Confirm the delinquent solid waste service charges as special assessments, authorize the recording of liens against the respective parcels, and direct the placement of the assessments on the FY2026/27 secured property tax roll; and

c)                     Approve a $62 administrative lien charge per affected parcel to recover the County's costs associated with processing delinquent accounts and lien releases.

 

5.                     Authorize the Director of Resource Management, or their designee, to execute and record Releases of Liens upon payment in full of delinquent amounts.

 

SUMMARY:

 

This item requests Board approval to complete the annual statutory process for collecting delinquent solid waste service charges through special assessments and property liens. Pursuant to Chapter 23 of the Solano County Code and Government Code sections 25830 through 25833, delinquent solid waste service charges that remain unpaid for more than 60 days may be collected through the secured property tax roll following a duly noticed public hearing.

 

Solid waste services in unincorporated Solano County are provided by Recology Vacaville Solano, Recology Vallejo, Rio Vista Sanitation Service dba Mt. Diablo Resource Recovery, and Solano Garbage Company dba Republic Services (collectively the “Contractors”). Pursuant to Chapter 23 of the Solano County Code, solid waste service charges billed by the Contractors become delinquent 30 days after the billing date and charges that remain unpaid for more than 60 days after billing are eligible for lien proceedings

 

On June 23, 2026, the Board of Supervisors set July 28, 2026, as a public hearing date to consider adoption of resolutions confirming the report of delinquent solid waste accounts and authorizing the recording of property liens, and directed notice to be mailed to the affected property owners and delinquent account holders. Since that time, the Contractors have continued to receive payments and provide updated delinquent account reports. Accordingly, staff will present the Final Report of Delinquent Solid Waste Accounts at the hearing reflecting payments received and any administrative corrections made before Board action.

 

Following the noticed public hearing required by Government Code section 25831, the Board may confirm the report of delinquent accounts and authorize the Auditor-Controller to place the delinquent fees and approved administrative charges on the FY2026/27 secured property tax roll as special assessments. In order to be included on the FY2026/27 tax roll, the liens must be submitted to the Auditor-Controller by August 10, 2026. The delinquent charges will thereafter be collected in the same manner as property taxes.

 

FINANCIAL IMPACT:

 

Delinquent service fees collected through the special assessment process will be remitted to the respective service providers. The $62 administrative lien charge assessed for each affected parcel is intended to partially recover the County's administrative costs associated with administering the annual delinquent solid waste lien process, including processing delinquent accounts and recording releases of liens.

 

The costs associated with administering the annual delinquent solid waste lien process are included in the Department's FY2026/27 Working Budget and are partially offset by the administrative lien charge. The costs associated with preparing this agenda item are nominal and included in the Department’s FY2026/27 Working Budget.

 

DISCUSSION:

 

Solid waste services in unincorporated Solano County include the collection and disposal of solid waste, recyclables, organics, and household hazardous waste. Each contractor serves a designated service territory within the unincorporated area of the County and provides residential, commercial and industrial solid waste collection services.

 

Government Code sections 25830 through 25833, together with Chapter 23 of the Solano County Code, establish the procedures for collecting delinquent solid waste service charges through special assessments and property tax liens. For the billing period of April 1, 2025, through March 31, 2026, the contractors referred and submitted a Report of Delinquent Solid Waste Accounts to the County for lien proceedings. The report lists the delinquent amounts, property owners, assessor parcel numbers, account holders, and service addresses.

 

Before initiating lien proceedings, both the County and the Contractors made multiple efforts to obtain voluntary payment. The Contractors contacted delinquent account holders by telephone over a three-week period. The County mailed two notices of the public hearing to both the affected property owners and delinquent account holders. Notice of the hearing was also published on July 12, 2026, in the Daily Republic (Fairfield), The Reporter (Vacaville), and the Times-Herald (Vallejo).

 

Following the public hearing, the Board may revise the report, confirm the delinquent accounts by resolution, authorize the recording of liens, approve the administrative charge, and direct placement of the delinquent charges on the secured property tax roll.

 

Because payments continue to be received and updated delinquent account reports are provided by the Contractors before the public hearing, the report presented to the Board at the hearing may differ from the preliminary report included with the agenda.

 

ALTERNATIVES:

 

The Board may choose not to adopt the resolutions confirming the report of delinquent accounts to complete the special assessment and lien proceedings against the associated real properties. This alternative is not recommended because Chapter 23 of the Solano County Code authorizes the Contractors to assign delinquent accounts to the County for annual lien proceedings.  Declining to adopt the resolutions would prevent the County from completing the statutory collection process authorized by Chapter 23 of the Solano County Code and Government Code sections 25830 through 25833, requiring the Contractors to pursue alternative collection remedies.

 

OTHER AGENCY INVOLVEMENT:

 

The contractors (Recology Vacaville Solano, Recology Vallejo, Rio Vista Sanitation Service dba Mt. Diablo Resource Recovery, and Solano Garbage Company dba Republic Services) coordinated with County staff throughout the lien process by providing updated delinquent account reports and making multiple attempts to obtain voluntary payment before the public hearing.
