DEPARTMENTAL RECOMMENDATION:
It is recommended that the Board adopt an ordinance amending Chapter 2.4 of the Solano County Code relating to airports and aircraft.
SUMMARY/DISCUSSION:
As the county develops and the complexity of issues increases, it becomes critical that we maintain a current Solano County Code because it contains the county’s body of laws as enacted by the Board of Supervisors’ ordinances and keeps the public properly informed.
Although we have now retained a publishing company to efficiently maintain our code, the current code requires extensive technical revision. The majority of the proposed amendments to Chapter 2.4 will make technical changes to correct, update or eliminate archaic or unnecessary language and provisions. Some of the amendments reflect substantive changes in the governing regulations and advising bodies.
Specifically, the governing regulation for flying clubs is now Federal Aviation Administration (FAA) Order 5190.6B. Additionally, since the order is subject to change, to ensure ease of compliance, we merely incorporate the order, rather than spelling out specific compliance requirements.
We clarified the confusion created by changing the reference to a fire chief from a fire marshal, in approving compliance with certain safety rules relating to the storage of motor vehicles within hangers.
We changed the financial responsibility provisions to provide the County Risk Manager with greater flexibility in determining the amount of insurance coverage and the type of confirming evidence by owners of aircraft. We also included the obligation to pay all possessory interest taxes that may be levied as a result of an aircraft owner’s use of the airport which is currently outlined in the Standards for Aviation Operators.
We clarified the conditional requirement for written approval of access agreements by Cal Trans, Division of Aeronautics and the Federal Aviation Administration.
Finally, the ordinance updates the change in the advisors to the airport manager to the Nut Tree Advisory Committee and the General Services Department relating to the issuance of rules and regulations to implement the policies and standards set forth in the ordinance.
FINANCIAL IMPACT:
There is no net impact on the General Fund.
ALTERNATIVES:
The Board could refuse to adopt the ordinance, but we recommend against this option because the changes reflect current conditions and existing law.

We consulted with the Airport Manager, the Risk Manager and the County Administrator’s Office.
