DEPARTMENTAL RECOMMENDATION:
The Department of Health and Social Services recommends that the Board of Supervisors:
1. Approve a Memorandum of Understanding (MOU) with the Superior Court of California, County of Solano (Court), for $149,403 to support the implementation of the Proposition 36 program monitoring and data reporting activities, a component of the Community-Based Substance Use Expansion grant, for the period of July 1, 2026, through March 31, 2027; and
2. Delegate authority to the County Administrator to execute the agreement and any subsequent amendments, with County Counsel concurrence, up to a fiscal year aggregate of $74,999.
SUMMARY/DISCUSSION:
The recommended Memorandum of Understanding (MOU) facilitates reimbursement to the Court for the implementation and continuation of state-mandated program monitoring and data reporting activities associated with the Proposition 36 (Prop 36) Community-Based Substance Use Expansion grant.
Prop 36 funds statewide efforts to expand access to recovery supports and substance use treatment and ensures compliance with data and reporting requirements. Under the MOU, the Court will employ a 0.5 FTE Operations Analyst responsible for preparing quarterly and annual Prop 36 compliance reports, presenting program data at bi-monthly Prop 36 meetings, and customizing and maintaining the case-management system to track participant cases, services, and outcomes, as well as automated notifications. This position also maintains staffing reports, attendance logs, tool-completion records, and program refinement feedback. The County will reimburse the Court quarterly for the allowable salary and benefit costs associated with the position. This agreement allows both the Court and the County to fully utilize Prop 36 funding, ensuring accurate reporting, State compliance, and coordinated program monitoring.
FINANCIAL IMPACT:
Solano County was awarded $665,150 in Prop 36 grant funding to be expended by March 31, 2028. The Board of Supervisors approved acceptance of these funds on August 4, 2026, and appropriations were added to the FY2026/27 Working Budget for anticipated expenses in this fiscal year, which included expenses for the MOU with the Court. This action does not impact the County General Fund. There is no expectation of ongoing funding for the position within the Court past the term of the agreement.
ALTERNATIVES:
The Board may choose not to approve the MOU. However, this is not recommended, as the Court would be unable to use Prop 36 funding, resulting in the loss of reimbursement for required reporting functions and limiting Solano County’s ability to meet State compliance obligations.
OTHER AGENCY INVOLVEMENT:
The Superior Court of California, County of Solano, and the Department of Health and Social Services developed the agreement. County Counsel has reviewed and approved the MOU as to form.
