DEPARTMENTAL RECOMMENDATION:

 

The Department of Resource Management (Department) recommends that the Board of Supervisors adopt a resolution accepting the dedication of 0.30 acres of public right-of-way along Tremont Road (County Road No. 86) and 0.62 acres of public utility easement for Minor Subdivision MS-24-02 (Realized Dreams).

 

SUMMARY:

 

Offers of dedication through the subdivision process are vital to ensure the proper width of public right-of-way, in accordance with the Solano County Road Improvement Standards and Land Development Requirements. The additional right-of-way widths dedicated by these actions provide for safety enhancements and improvement opportunities for the county’s road system. This may include improved sight lines, addition of shoulders and drainage ditches amongst other improvements.

 

The public right-of-way considered for dedication is located along the southerly frontage of Tremont Road, totaling 5-feet in width and approximately 2,647-feet in length. This equates to approximately 0.30 acres. The public utility easement being considered for dedication is located along the westerly boundaries of Parcels 1 and 3, 10-feet in width and approximately 2,712-feet in length. This equates to a combined area of approximately 0.62 acres.

 

The dedication of public right-of-ray satisfies the current half-width requirements of the Solano County road system as set forth in the Solano County Road Improvement Standards and Land Development Requirements. The offers of dedication are in accordance with Chapter 26 of the Solano County Code and adoption of the resolution (Attachment C) will result in the dedications being accepted by the recording of the parcel map with the County Recorder.

 

FINANCIAL IMPACT:

 

The existing maintenance of Tremont Road falls under the Road Fund; therefore, accepting the public right-of-way dedication has no impact to the General Fund. This additional public right-of-way does not increase the total road miles maintained but increases the available land for the ultimate width of the right-of-way to meet the Board adopted County Road Improvement Standards.

 

The costs associated with preparing this agenda item are nominal and absorbed by the Department’s FY2025/26 Working Budget.

 

DISCUSSION:

 

Minor Subdivision MS-24-02 creates ten parcels, ranging from 41.0 acres to 47.0 acres each. With all parcels being 40 acres or more, Government Code §66426 (d) allows the map to be processed as a minor subdivision (parcel map). Located in the Exclusive Agricultural ‘A-40’ Zoning District, Parcels 1 and 2 front Tremont Road (County Road No. 86) and Parcel 10 fronts Hyde Road (County Road No. 104) along the Solano-Yolo County line and southeast of Davis, approximately 5 miles east of Interstate 80, in the unincorporated area of Dixon in Solano County (Attachment A).

 

The Tentative Map was approved with conditions through a noticed public hearing held by the Board of Supervisors on August 12, 2025, through Resolution No. 2025-182 and supplemented by Resolution No. 26-05 by the Zoning Administrator on March 5, 2026. Condition number 15 of the Conditions of Approval for Minor Subdivision MS-24-02 requires the subdivider dedicate public right-of-way totaling 5-feet in width along the existing frontage of Tremont Road to achieve an ultimate half-width of 35-feet from the centerline of the existing right-of-way. Condition number 25 requires the subdivider dedicate a public utility easement along the west side of Parcels 1 and 3 for the existing overhead utility lines.

 

Pursuant to Solano County Code Chapter 26-104(b), the County Surveyor has approved the parcel map (Attachment B), pending acceptance of the offer of dedication by the Board of Supervisors. Solano County Code Chapter 26-133.6 requires all offers of public dedication on a parcel pap be formally accepted (or rejected) by the Board of Supervisors prior to the recordation of the parcel map.

 

ALTERNATIVES:

 

The Board of Supervisors may choose to reject the offers of dedication of public right-of-way and instead purchase the property in the future when needed for road purposes. This is not recommended, as dedications for road purposes are a requirement of County policies contained in Chapter 26 of the Solano County Code. These policies are intended to mitigate the impacts of new development on the county road system.
