DEPARTMENTAL RECOMMENDATION:
The Department of General Services recommends that the Board of Supervisors:
1. Approve the Notice of Completion (Attachment A) for the replacement of the emergency generator at the Health and Social Services located at 2101 Courage Drive in Fairfield, constructed by Western Machinery Electric of Benicia; and
2. Authorize the Clerk of the Board to record the executed Notice of Completion.
SUMMARY:
On February 9, 2016, the Board awarded a construction contract to Western Machinery Electric to replace the emergency generator and related utilities at the Health and Social Services building located at 2101 Courage Drive in Fairfield (Project). During the course of the construction, the quality of work satisfied the requirements of the construction documents and has been deemed code compliant. General Services is requesting that the Board approve the Notice of Completion for the project and authorize the Clerk of the Board to record the document in order to release funds held by the County.
FINANCIAL IMPACT:
The Board previously approved $340,000 in Accumulated Capital Outlay Fund (Budget Unit 1695) to fund the project. The project budget was reduced by $70,000 due to updated cost estimates. Those funds reverted to ACO Contingencies at FY 2015-16 year-end closing. The total amount of construction expenses associated with Western Machinery Electric’s agreement is $190,149. The total project cost, including fees and project management, is $253,563. Remaining project funds of $16,437 will be returned to the Accumulated Capital Outlay Fund Contingencies. The Project budget and expenses are summarized in Attachment B.
DISCUSSION:
The Project replaced the emergency generator and the automatic transfer switches at the Health and Social Services located at 2101 Courage Drive in Fairfield. The previous existing emergency generator had reached the end of its useful life, and was no longer reliable. During the construction one contract change order, for conduit rerouting, was issued to Western Machinery Electric increasing the original construction contract in the amount of $175,027 by $15,122, resulting in a final construction contract amount of $190,149.
ALTERNATIVES:
The Board could choose not to execute and record the Notice of Completion. This action is not recommended since Western Machinery Electric has successfully fulfilled the terms of the contract. Failure to adopt the Notice of Completion will prevent release of retention funds and payments to the General Contractor, which could result in adverse claims.
OTHER AGENCY INVOLVEMENT:
The Department of Resource Management Building and Safety Division inspected project improvements for code compliance. The Bay Area Air Quality Management District issued a permit to construct for the emergency generator replacement.
CAO RECOMMENDATION:
APPROVE DEPARTMENTAL RECOMMENDATION
