DEPARTMENTAL RECOMMENDATION:
The Department of Resource Management recommends that the Board of Supervisors:
1. Adopt a resolution (Attachment A) approving the Final Map for the Morgan Subdivision - Phase 2 (S-18-02); and
2. Accept the dedication of a Public Utility Easement (P.U.E).
SUMMARY:
The Morgan Subdivision - Phase 2 Final Map (Attachment B) is the second phase of the Tentative Subdivision Map approved under Application S-18-02, which proposes to ultimately subdivide approximately 310 acres of the Lands of Morgan into 19 lots. The Tentative Map was conditionally approved by the Solano County Board of Supervisors on May 12, 2020, through Resolution No. 2020-87 (Attachment C). The Final Map for Phase 1, which created the initial 4 lots, was approved on May 4, 2021, via Resolution No. 2021-90 (Attachment D) and recorded on June 23, 2021, in the Office of the Solano County Recorder, Book 96 of Maps, Pages 1-6.
Phase 2 consists of 10 additional lots. A future Phase 3 will include the remaining 5 lots; however, the timeline for that phase has not yet been determined.
FINANCIAL IMPACT:
The Road Fund is not impacted as the Public Utility Easement (P.U.E.) is fully within the Private Access Easement, located on private property and is the responsibility of the owners to maintain. The cost of processing, review, and various inspections of the development are paid through fees by the subdivider. The costs associated with preparing this agenda item are nominal and absorbed by the Department’s FY2024/25 Working Budget.
DISCUSSION:
The Morgan Subdivision - Phase 2 Final Map (S-18-02) proposes to subdivide approximately 254 acres of the remaining property into 10 lots, ranging in size from 6.7 to 21.3 acres. The project site is located southwest of the intersection of Gibson Canyon Road and Cantelow Road.
Lots 5 - 11 are accessed via a newly constructed private road, Gibson Canyon Court, which connects to Gibson Canyon Road (County Road No. 93) through a Private Access Easement approximately 1,100 feet south of the intersection with Cantelow Road (County Road No. 272). Lots 12-14 front directly onto Gibson Canyon Road.
The Rural North Vacaville Water District and the Vacaville Fire Protection District have verified that all applicable conditions for this phase have been satisfied. Each of the 10 lots is connected to domestic water service provided by the Rural North Vacaville Water District. On-site sewage disposal systems will be required, and Department-supervised testing indicates that engineered systems will be necessary.
In accordance with the Conditions of Approval and County Code, a Road Maintenance Agreement covering Gibson Canyon Court has been submitted and will be recorded concurrently with the Final Map. Additionally, a P.U.E. is required to ensure public utilities can be provided to all parcels along the newly created 60-foot Private Access Easement serving lots 5-11 and is also a part of the conditions of approval.
This phase is located within the CalFire State Responsibility Area (SRA). Fire protection requirements imposed by the Vacaville Fire Protection District, such as hydrant installation and driveway design, have been met to ensure adequate fire suppression access.
Under Solano County Code Chapters 26-102 and 26-104(a), the County Surveyor recommends that the Board approve the Final Map and accept the dedication of a Public Utility Easement (P.U.E.).
ALTERNATIVES:
The Board of Supervisors may choose to reject the offers of dedication of a Public Utility Easement (P.U.E.), and not approve the filing of the Phase 2 Final Map. This is not recommended as the applicant has met all Conditions as previously set forth by the County for this subdivision.
