DEPARTMENTAL RECOMMENDATION:

 

The Director of Human Resources recommends that the Board of Supervisors adopt a resolution to amend the Alphabetical Listing of Classes and Salaries to establish a monthly salary of $3,368.12 - $4,135.16 for Legal Procedures Clerk (Entry) (Confidential) and $3,967.52 - $4,930.66 for Legal Procedures Clerk (Senior) (Confidential).

 

SUMMARY:

 

The County has an established wage for Legal Procedures Clerk (Confidential); however, there is no corresponding wage for Legal Procedures Clerk (Entry) or Legal Procedures Clerk (Senior) who are designated as a confidential employee.  The proposed action establishes a wage for the entire Legal Procedures Clerk classification series for an employee who is designated as a confidential employee.

 

FINANCIAL IMPACT:

 

There is no financial impact in amending the Alphabetical Listing of Classes and Salaries.  Any financial impact is dependent on any Legal Procedures Clerk vacancy which may occur and the hiring department hires at either the entry or senior level and the position is designated as a confidential employee.

 

DISCUSSION:

 

A confidential employee is “any employee who is privy to the decision-making process of County management affecting employee relations” (Employer-Employee Relations Rules and Regulations, Article I, General Provisions, Section 2, Definitions).

 

The Alphabetical Listing of Classes and Salaries identifies a number of classifications with a confidential designation, which includes Accounting Clerk I/II, Accounting Technician, Clerical Operations Supervisor, Legal Supervisor, Office Coordinator, Office Supervisor, Legal Secretary, Office Aide, Office Assistant I/II/III and Legal Procedures Clerk.  Although a department may wish to designate either a Legal Procedures Clerk (Entry) or Legal Procedures Clerk (Senior) as a confidential employee, there is not an established wage for an employee in either job classification.

 

In recent recruitments, the Human Resources Department has been challenged in finding sufficient journey-level Legal Procedures Clerk.  A hiring department may find it beneficial to hire at the entry-level and providing the requisite training to advance an individual to journey Legal Procedures Clerk.  The Legal Procedures Clerk (Senior) is the advanced journey level classification within the job series, characterized by the responsibility to lead the work of others.

 

The proposed action establishes the wage for Legal Procedures Clerk (Entry) (Confidential) and Legal Procedures Clerk (Senior) (Confidential), setting the wages at 1.28169% above the non-confidential classification.  The 1.28169% wage differential for the confidential designation is consistent with other classifications’ confidential wage differential.

 

ALTERNATIVES:

 

The Board of Supervisors could opt to not establish a wage for Legal Procedures Clerk (Entry) and/or Legal Procedures Clerk (Senior) designated as a confidential employee; however, this option is not recommended as it limits a department’s ability to utilize a Legal Procedures Clerk as a confidential employee.

No other agency was involved.
