DEPARTMENTAL RECOMMENDATION:
The Department of Resource Management recommends that the Board of Supervisors adopt a resolution accepting the dedication of a Public Roadway and Public Utility Easement, approximately 12,490 square feet (0.29 acres) for right-of-way purposes along Steiger Hill Road and Cantelow Road, and a 20’ wide Slope Easement, approximately 22,190 square feet (0.51 acres) for slope maintenance purposes along Cantelow Road, north of Midway Road, for Minor Subdivision MS-21-01 (Sellers).
SUMMARY/ DISCUSSION:
Minor Subdivision MS-21-01 creates two parcels, 31.90 acres and 24.50 acres each, within the Exclusive Agricultural ‘A-20’ Zoning District. Parcel D-1 fronts Steiger Hill Road (County Road No. 444) and Cantelow Road (County Road No. 272) and Parcel D-2 fronts Cantelow Road (County Road No. 272) approximately 0.5 miles north of the City of Vacaville in the unincorporated area of Solano County (Attachment C). The Tentative Map was conditionally approved through a noticed public hearing held by the Zoning Administrator on February 1, 2024. Number six of the Conditions of Approval for Minor Subdivision MS-21-01 requires the subdivider dedicate a Public Roadway and Public Utility Easement for right-of-way purposes to achieve an ultimate halfwidth of 35-feet from the centerline of the existing rights-of-way. Parcel D-1 dedicates a 5-foot wide Public Roadway and Public Utility Easement along the westerly frontage of Steiger Hill Road (County Road No. 444) and the southerly frontage of Cantelow Road (County Road No. 272) approximately 730-feet in length and Parcel D-2 dedicates a 5-foot wide Public Roadway and Public Utility Easement along the southerly frontage of Cantelow Road (County Road No. 272) approximately 1,768-feet in length). Additionally, Parcel D-2 dedicates a 20’ wide Slope Easement along the southerly frontage of Cantelow Road approximately 1,768-feet in length.
The dedication of both Public Roadway and Public Utility Easements satisfies the current right-of-way half-width requirements of the Solano County Road System as set forth in the Solano County Road Improvement Standards and Land Development Requirements. Additionally, the dedication of the Slope Easement satisfies the County’s ability to stabilize and maintain the hillside along that existing portion of Cantelow Road.
This offer of dedication is in accordance with Chapter 26 of the Solano County Code and adoption of the Resolution (Attachment A) will result in the dedications being accepted and recorded with the Parcel Map with the County Recorder’s Office. Offers of dedication through the subdivision process are vital to ensure the proper width of public right-of-way in accordance with the Solano County Road Improvement Standards and Land Development Requirements. The additional right-of-way widths provide for safety enhancements and improvement opportunities for the County’s Road System. Pursuant to Solano County Code §26-104(b), the County Surveyor has approved the Parcel Map (Attachment B) pending acceptance of the offers of dedication by the Board of Supervisors. Solano County Code §26-133.6 requires all offers of public dedication on a Parcel Map be formally accepted (or rejected) by the Board of Supervisors prior to the filing of the Parcel Map.
FINANCIAL IMPACT:
The existing maintenance of Cantelow Road and Steiger Hill Road is funded by the Road Fund; therefore, accepting these public roadway dedications has no impact on the County General Fund. This additional public right-of-way does not increase the total road miles maintained but increases the available land for the ultimate width of the right-of-way to meet the Board adopted County Road Improvement Standards.
The costs associated with preparing this agenda item are nominal and absorbed by the Department’s FY2025/26 Working Budget.
ALTERNATIVES:
The Board of Supervisors may choose to reject the offers of dedication of Public Roadway and Public Utility Easements for right-of-way purposes, and Slope Easement and instead purchase the property in the future if it were needed for road purposes. This is not recommended, as dedications for road purposes are a requirement of County policies contained in Chapter 26 of the Solano County Code. These policies are intended to mitigate the impacts of new development on the County Road System.
