DEPARTMENTAL RECOMMENDATION:
The Department of Resource Management recommends that the Board of Supervisors adopt a resolution accepting the dedication of a Public Roadway and Public Utility Easement, approximately 24,257 square feet (0.5569 acres), for right-of-way purposes along Putah Creek Road for Minor Subdivision MS-22-06 (Melendez).
SUMMARY:
On April 25, 2023, the Board held a public hearing and approved Minor Subdivision MS-22-06, subdividing an approximately 82.13-acre parcel into two (2) parcels: Parcel 1 being 41.13 acres and Parcel 2 being 41.00 acres in area, and zoned A-40. The purpose of the subdivision was to separate a commercial walnut orchard into two equal parts, which would allow for construction of a primary dwelling on Parcel 2 at a future date. This item came to the Board due to underlying Williamson Act contracts and the Tentative Map was conditionally approved by the Board of Supervisors with the approval of the minor subdivision. Both parcels front Putah Creek Road and Winter Roads, west of Highway 505, approximately 0.25 miles south of the City of Winters, in the unincorporated area of Solano County (Attachment A - Parcel Map).
The Solano County Road Improvement Standards require the applicant dedicate a Public Roadway and Public Utility Easement for right-of-way purposes along Putah Creek Road, west and south of the intersection with Winters Road. This dedication is located along the northern and western frontage of Parcel 1 and a portion of the western frontage of Parcel 2, varying in width from 5 feet to 10 feet. This offer of dedication within the Parcel Map is in accordance with Chapter 26 of the Solano County Code. Adoption of the resolution (Attachment B - Resolution) will result in the dedication being accepted and recorded along with the Parcel Map by the County Recorder.
FINANCIAL IMPACT:
The existing maintenance of Putah Creek Road falls under the Road Fund; this action has no impact on the General Fund. This additional Public Roadway and Public Utility Easement does not increase total road miles maintained but does increase available right-of-way for enhanced safety and potential future improvement of Putah Creek Road.
The costs associated with preparing this agenda item are nominal and absorbed by the Department’s FY2024/25 Working Budget.
DISCUSSION:
Offers of dedication through the subdivision process are vital to ensure the proper width of public right-of-way, in accordance with the Solano County Road Improvement Standards and Land Development Requirements. The additional right-of-way widths provide for safety enhancements and improvement opportunities for the County’s road system.
Pursuant to Solano County Code Chapter 26-104(b), the County Surveyor has approved the Parcel Map, pending acceptance of the offer of dedication by the Board of Supervisors. Solano County Code Chapter 26-133.6 requires all offers of public dedication on a Parcel Map be formally accepted (or rejected) by the Board of Supervisors prior to the filing of the Parcel Map.
ALTERNATIVES:
The Board of Supervisors may choose to reject the offer of dedication of a Public Roadway and Public Utility Easement for right-of-way purposes, and instead purchase the property in the future if it were needed for road purposes. This is not recommended since dedications for road purposes are a requirement of County policies contained in Chapter 26 of the Solano County Code that are intended to mitigate the impact of new development on the County road system.
