DEPARTMENTAL RECOMMENDATION:
It is recommended that the Board of Supervisors adopt a resolution authorizing the continuance of the ability remote teleconference meetings of the Solano County Board of Supervisors for the period of February 8, 2022 through March 10, 2022 under the Ralph M. Brown Act.
SUMMARY/DISCUSSION:
Since the beginning of the COVID-19 pandemic state of emergency, there were a variety of Executive Orders that suspended and/or waived public meeting requirements under the Ralph M. Brown Act (“Brown Act”) that were in place through September 30, 2021. On September 16, 2021, Governor Newsom signed into law Assembly Bill 361 ("AB 361") which amended the. Brown Act to authorize modified procedures for remote (teleconference) meetings held during a state of emergency and when state or local officials impose or recommend measures to promote social distancing. (See Gov. Code § 54953(e).) In order to utilize these modified procedures, the Brown Act requires the Board of Supervisors to find, by a majority vote, that it has considered the circumstances of the state of emergency, and (i) the state of emergency continues to directly impact the ability of the members to meet safely in person and/or (ii) state or local officials continue to impose or recommend measures to promote social distancing. The findings must be made no later than 30 days after using the modified procedures, and every 30 days thereafter.
On January 11, 2022, the Board adopted Resolution No. 2022-5 that authorized the implementation of AB 361 to allow for Board of Supervisors, any one or all of its members, and any of its legislative bodies to conduct their meetings by teleconferencing between January 11, 2022 and February 10, 2022 in accordance with AB 361 when state or local officials impose or recommend measures to promote social distancing. Adoption of the attached resolution (Attachment A) will authorize the continuance of that ability for the period of February 8, 2022 to March 10, 2022.
