Unit 16 Association of Mid-Management Professionals of Solano County (“Unit 16” or “AMMPS”) petition to include the Compliance and Quality Assurance Analyst classification in Unit 16

HUMAN RESOURCES' RECOMMENDATION:

The Director of Human Resources recommends that the Civil Service Commission (Commission) grant

AMMPS’s request to include the Compliance and Quality Assurance Analyst in Unit 16. The Employer-Employee Relations Rules and Regulations (EERRR) requires the Commission to make the final determination on the appropriateness of a representation unit.

 

SUMMARY:

The Compliance and Quality Assurance Analyst classification is not covered under civil service and is an unrepresented classification. On October 23, 2025, Local 21 sent correspondence on behalf of AMMPS to request modification of Unit 16 to include the CQA Analyst classification series, which includes entry and journey levels.

 

In accordance with the EERRR, on November 24, 2025, the Department of Human Resources provided notice to the employees in the proposed unit and to any person or employee organization that filed a written request for such notice. The EERRR provides that within 30 days of the notice date, a second employee organization may challenge the appropriateness of the proposed unit modification and may petition for the establishment of a different unit. No such petitions were received. The proposed unit modification is to add one classification (Compliance & Quality Assurance Analyst) to Unit 16. This classification has three authorized positions. In addition to the petition correspondence, Local 21 submitted signed copies of current incumbents’ membership application.

 

The final step is for the Commission to make the final determination on the appropriateness of the

representation unit.

 

DISCUSSION:

The Compliance and Quality Assurance Analyst classification is unrepresented and not covered under civil service. The classification was originally established as Compliance Officer on May 1, 2007 within the Department of Human Resources. On or about April 22, 2014, the four existing Compliance Officer positions were reclassified to three new job classifications, Compliance and Quality Assurance Manager (1), Deputy Compliance and Quality Assurance Manager (1) and Compliance and Quality Assurance Analyst (2).  The four positions were subsequently reallocated to the Department of Health and Social Services (H&SS) on May 25, 2014.

 

All classifications remained unrepresented until Local 21 requested to have the Deputy Manager position included in Unit 19 -Executive and Senior Management, which was approved on or about April 8, 2015.  In October 2021, Local 21 then requested, as a community of interest, to also include the Compliance Manager in Unit 19.  The Civil Service Commission approved this request on May 11, 2022. On January 7, 2020, the Deputy Compliance Manager was deleted, and an additional allocation was added to the Compliance and Quality Assurance Analyst series. Currently, there are three allocations in the classification of Compliance and Quality Assurance Analyst, one allocation of Compliance and Quality Assurance Manager, and no allocation for the Deputy Compliance and Quality Assurance Manager.

 

The Compliance & Quality Assurance Analyst is responsible for reviewing, monitoring and evaluating program areas within the Department of Health and Social Services with a goal of regulatory compliance and continuous quality improvement.  Additional responsibilities include but are not limited to conducting compliance reviews in accordance with state issued guidelines and internal policies and procedures; developing compliance measurement systems, conducting investigation of alleged violation of compliance-related laws and make recommendation for corrective action plans, and conducting quality assurance reviews to monitor and evaluate the quality and appropriateness of various service programs; developing and recommending new/revised procedures and corrective actions plans. 

 

On or about October 23, 2025, AMMPS requested to modify Unit 16. The correspondence sent by  Local 21, stated the following:

 

“The Compliance & Quality Assurance Analyst job classification shares a community of interest with classifications in Bargaining Unit #16 in the following ways, which is not exhaustive:

                     The classification is a professional-level job class.

                     The classification is designated as FLSA-exempt. The incumbents receive administrative leave in lieu of overtime pay, which is in line with other classifications in Bargaining Unit #16.

                     Incumbents to the Compliance & Quality Assurance Analyst classification work in close proximity to and in collaboration with other Unit #16 employees.

                     Incumbents to the classification do not have the ability to supervise, hire, fire, or otherwise discipline other members of the bargaining unit.

                     The classification reports to a senior management level classification that is assigned to represented Bargaining Unit #19.

                     The minimum qualifications are within the same range as many classifications in Bargaining Unit #16.

                     The incumbents are required to attain and maintain special certifications necessary for carrying out official duties. This is also a common requirement of incumbents to classifications in Unit #16.

                     The classification's prescribed benefit package is comparable with other classifications represented by IFPTE Local 21 in Solano County”

 

In review of the request and the Employer Employee Relations Rules and Regulations, as well as the preceding unit modification changes for the Compliance and Quality Assurance Manager and the Deputy Compliance and Quality Assurance Manager who are presently represented by Local 21 - Unit 19, the Department of Human Resources does not oppose representation of the Compliance and Quality Assurance Analyst job series by the AMMPS Unit 16 bargaining group.

 

 

ALTERNATIVES:

The Commission could elect to reject the staff’s recommendation and move forward with a hearing in

order to make its own conclusion regarding whether the Compliance and Quality Assurance Analyst should be included in Unit 16.

 

OTHER AGENCY INVOLVEMENT:

The Human Resources Department worked with the County Administrator and County Counsel to review

the documentation in this matter in case the Commission elects to have a hearing on this matter.
