DEPARTMENTAL RECOMMENDATION:

 

The Department of General Services recommends that the Board of Supervisors:

 

1.                     Approve seven Job Order Contracting (JOC) Construction Agreements, each with an initial maximum contract value of $1,000,000;

 

2.                     Authorize the County Administrator or designee to execute the Agreements, any subsequent amendments, and respective job orders greater than $200,000, with County Counsel concurrence, and within the approved project budgets;

 

3.                     Delegate signing authority to the fiscally responsible department head to sign respective job orders of $200,000 or less, with County Counsel concurrence, and within the approved project budgets; and,

 

4.                     Delegate signing authority to the General Services Director or designee to execute any Notice of Completion for any projects completed through the JOC program.

 

 

 

 

SUMMARY:

 

The General Services Department (GSD) recommends the Board of Supervisors approve seven new JOC Construction Agreements to support ongoing County facility maintenance, repairs, and minor construction needs (Attachment A). The agreements cover specific license classifications required for anticipated capital improvement projects in FY2025/26.

 

The GSD JOC 2025 contracts were publicly advertised and awarded through competitive bidding process in accordance with the CA Public Contact Code.  Contracts were awarded to the lowest responsive and responsible bidders. 

 

Originally approved by the Board on September 13, 2022, the JOC program was established to streamline the delivery of recurring small- to mid-sized construction projects.  It reduces administrative costs and accelerates project delivery through pre-established unit pricing.  These agreements replace expiring JOC contracts approved by the Board on May 24, 2024, and terminated on June 4, 2025. 

 

FINANCIAL IMPACT:

 

Each JOC agreement is a unit price, indefinite quantity contract with an initial maximum contract value of $1,000,000.  This means there is no fixed scope of work upfront; instead, work is assigned as needed, using pre-established unit prices, up to the contract limit.  There is no guaranteed commitment under each JOC contract.

 

Funding for JOC-assigned projects will come from approved capital project budgets or departmental operating budgets, as authorized by the Board.  If necessary to meet project demands, the maximum contract value may be increased by amendment, up to the current statutory limit of approximately $6.687 million.

 

The costs associated with preparing this agenda item are nominal and absorbed by the department’s FY2024/25 Working Budget.

 

DISCUSSION:

 

JOC Program

The JOC program streamlines procurement for small- to medium-sized construction projects.  Approved by the Board on September 13, 2022, and implemented through a service agreement with Gordian Group Inc. (“Gordian"), it allows multiple construction projects (repairs, renovations, maintenance, time-sensitive, and alterations) to be completed through competitively bid, indefinite quantity contracts. Gordian’s Construction Task Catalog®, which includes pre-priced labor, material, and equipment costs (adjusted annually based on the local Construction Cost Index, forms the basis of the pricing.  Contractors bid an adjustment factor, covering indirect costs and profit), applied to the catalog. 

 

Job orders are issued based on contractor license, qualifications, and project fit.  Benefits of the program include faster project delivery, reduced administrative burden, improved cost control, and increased flexibility for addressing deferred maintenance.  Each JOC agreement is valid for one year and may be amended, if needed, up to the current statutory maximum (approximately $6.687 million).  Job orders issued within the contract term remain valid through project completion. 

 

JOC Solicitation/Bid Process

On March 5, 2025, GSD issued a Notice to Bidders for 2025 JOC program, seeking at least one contractor for each License Class A (General Engineering) and Class B (General Building).  Notices were published in local newspaper on March 5 and March 12, 2025; posted on the County’s purchasing platform (OpenGov); shared with the local trade organization, plan rooms, trade journals, and contractor lists; and posted on the GSD’s Capital Project Management’s website. 

 

The bid package included Project Manual, Technical Specifications, and Gordian’s Construction Task Catalog®.   Contractors submitted adjustment factors representing indirect costs and profit. A mandatory pre-bid meeting, supported by Gordian, was held on March 12, 2025, with 18 contractors in attendance, including two (2) County-based contractors.

 

Bid Results, Contract Awards

Bids were publicly opened on April 15, 2025, with 14 submissions received, none from Solano County-based contractors (Attachment B).  Bids were ranked based on the lowest award criteria figures and completeness of required documentation.  After evaluation and review of anticipated JOC projects (Attachment C), a sufficient number of lowest responsive and responsible bidders were identified for award.  All recommended contractors submitted complete documentation, including required bonds, insurance, Department of Industrial Relations (DIR) registration, license verification, pre-award survey, references, financial reports, and project management plans, and were verified to be in good standing with the State of California.

 

Each agreement has an initial maximum contract value of $1,000,000, with no guaranteed minimum. Contract value increases as job orders are issued and may be amended, if needed, up to the current statutory limit (approximately $6.687 million).

 

Local Construction Industry Outreach/Participation

JOC contractors are required to make good faith efforts to engage local subcontractors on each job order.  “Local” is defined as a business with “a valid business license issued from the County of Solano or a political subdivision within the County; and its principal business office, or a satellite office with at least one full-time employee, located in the County.”

 

Since the program’s launch in 2022, the JOC program has played a significant role in advancing construction efforts while promoting local economic participation.  County-based subcontractors have been actively involved in the bidding process and have secured a meaningful share of work.  GSD remains committed to partnering with contractors to expand local outreach and strengthen opportunities for local business.

 

JOC Projects

The FY2024/25 - FY2028/29 Capital Facilities Improvement Plan (“CFIP”) adopted by Board on February 25, 2025, along with the FY2025/26 Recommended Budget, identifies numerous capital projects eligible for JOC delivery. A list of proposed projects, including public health and safety improvements, preservation and renewal of important building systems, and improvements promoting increased efficiency of County operations, is provided (Attachment C).  A representative list of JOC projects that are completed or currently under construction is provided (Attachment D).

 

Notice of Completion

Traditionally, Notice of Completion (NOC) are submitted to the Board for approval to confirm project completion and authorize retention release.  To streamline this process, GSD requests delegated authority for the General Services Director or designee to sign NOCs for JOC projects.  Annual reporting to the Board will continue.  This will expedite closeout, improve communication with contractors, and reduce administrative costs.

 

The General Services Department has prepared corresponding contracts for Board approval.  See links to JOC Construction Agreements attached.

 

ALTERNATIVES:

 

1.                     The Board could elect not to approve some or all JOC contracts.  This action is not recommended because the contracts were publicly advertised and competitively bid in accordance with the Public Contract Code.  Without these agreements, multiple capital projects identified in the CFIP and FY2025/26 Recommended Budget may be delayed, significantly reducing the effectiveness of the JOC program.

 

2.                     The Board could elect not to authorize the County Administrator or designee to execute the agreements, any subsequent amendments, and respective job orders greater than $200,000, with County Counsel concurrence, and within approved project budgets.  This action is not recommended because requiring separate Board approval for each contract, amendment, and job orders over $200,000 would slow project timelines and increase administrative burden.  Delegation ensures the JOC program can meet its goal of expedited project delivery.

 

3.                     The Board could elect not to delegate signing authority to the fiscally responsible department head to sign respective job orders of $200,000 or less, with County Counsel concurrence, and within the approved project budgets.  This action is not recommended because, without delegation, all job orders over $75,000 would require Board approval, limiting flexibility, increasing staff workload, and delaying routine and time-sensitive projects.

 

4.                     The Board could elect not to delegate NOC signing authority to the General Services Director or designee.  This action is not recommended as routing each NOC through Board would delay project closeout, prolong retention release to contractors, and increase administrative processing time.  Delegated NOC authority would maintain project momentum while preservice transparency through annual Board reporting.

 

OTHER AGENCY INVOLVEMENT:

 

The Project Manual and bid documents were reviewed by County Counsel; General Services’ Facilities Operations, Support Services - Purchasing and Administration divisions; Resource Management; and Gordian.  County Counsel reviewed and approved each agreement as to form. 

 

CAO RECOMMENDATION:

 

APPROVE DEPARTMENTAL RECOMMENDATION
