DEPARTMENTAL RECOMMENDATION:

 

The Department of General Services recommends that the Board of Supervisors:

 

Adopt a resolution delegating authority to the Director of General Services, or designee, to execute, amend, and terminate standardized month-to-month use agreements for County-owned hangars at the Nut Tree Airport.

 

SUMMARY/DISCUSSION:

 

The Nut Tree Airport is owned and operated by Solano County and functions as a public-use airport providing services to the aviation community. The Airport includes over 80 aircraft storage hangars that are made available to aviation users under standardized, month-to-month use agreements. Due to frequency of tenant turnover and ongoing operational needs, these agreements are processed on a regular basis.

 

Staff recommends that the Board delegate authority to the Director of the Department of General Services (“Director”), or designee, to execute, amend, and terminate standardized month-to-month hangar use agreements (licenses or permits) for County-owned Airport hangars.  This delegation is intended to streamline administrative processes and support consistent revenue generation without delays associated with individual board approvals.

 

These agreements are administrative and operational in nature and are intended to provide revocable permission for the use of County-owned Airport facilities for aircraft storage purposes.  They do not create long-term or exclusive possessory interests in County property.

 

The proposed delegation applies only to standardized, non-negotiated agreements that:

                     are month-to month in duration;

                     are revocable upon notice;

                     do not create long-term leasehold interests;

                     utilize standardized forms approved by County Counsel; and

                     are consistent with Board-approved rates and terms.

 

Amendments to these agreements are limited to administrative or non-substantive changes and shall not modify rates, extend use beyond a month-to-month basis, or materially alter Board-approved terms.  Any deviation from the approved form or material terms will require additional review and approval by County Counsel prior to execution.

 

All agreements executed pursuant to this Resolution will comply with applicable federal, state, and local laws, including Federal Aviation Administration (FAA) Grant Assurances where applicable, and County contracting requirements.  The County retains full authority and responsibility for the management and operation of the Airport.  General Services staff will maintain records of all agreements executed under this delegated authority and will provide a summary report to the Board upon request. 

 

FINANCIAL IMPACT:

 

There is no financial impact in approving this departmental recommendation. The costs associated with preparing the agenda item are nominal and absorbed by the department’s FY2025/26 Working Budget.

 

ALTERNATIVES:

 

The Board could choose not to adopt the resolution delegating authority to execute these use agreements. This action is not recommended as it would delay the process of the public applying for the agreements and potential loss of revenue.
