DEPARTMENTAL RECOMMENDATION:

 

The Sheriff recommends that the Board of Supervisors:

 

1.                     Adopt a resolution amending the List of Numbers and Classifications of Positions to add 2.0 FTE Sergeant-Sheriff (Limited-Term Project) through December 31, 2026 to provide supervision to the Deputies assigned to Vallejo to provide supplemental general law enforcement services; and

 

2.                     Approve an Appropriation Transfer Request to recognize unanticipated revenue from the City of Vallejo of $5,369,815 in the Sheriff’s Operating budget offset by appropriations for providing law enforcement services to Vallejo including fixed asset purchases and reducing the General Fund Contribution. (4/5 vote required)

 

 

SUMMARY/DISCUSSION:

 

In July 2023, the City of Vallejo (Vallejo) declared a public safety staffing emergency due to their low staffing levels and requested assistance from the Sheriff’s Office. Due to staffing challenges in the Sheriff’s Office, the Sheriff requested the assistance of Senator Bill Dodd to introduce SB 1379, which was signed into law by Governor Gavin Newsom in September 2024, to allow retired personnel to temporarily backfill key roles so active staff can assist Vallejo. Once the legislation was in place, the Sheriff’s Office developed and provided a term sheet to Vallejo in December of 2024. In March of 2025, Vallejo’s City Council authorized contract negotiations with the Sheriff.

 

On May 6, 2025, the Sheriff provided the Board of Supervisors (Board) with an informational presentation on its ability to provide temporary law enforcement assistance to Vallejo and requested direction on whether to proceed with contract discussions to provide such services. The Board authorized the Sheriff to proceed with contract negotiations with Vallejo based on a previously provided term sheet, contingent on three conditions;

 

                     Approval of the contract by Vallejo by July 1, 2025.

 

                     Written confirmation from the California Department of Justice (DOJ) that the Sheriff will not be subject to the existing settlement agreement between the DOJ, Vallejo, and the Vallejo Police Department.

 

                     The County must complete meet-and-confer process with Service Employees International Union (SEIU), Law Enforcement Management Association (LEMA), and the Deputy Sheriffs’ Association (DSA), regarding the proposed contract.

 

On June 17, 2025, the Vallejo City Council approved the contract. After completing the meet-and-confer process with the DSA, the Sheriff requested approval of the contract and side letter, which the Board of Supervisors granted on September 23, 2025, authorizing a one-year agreement with the City of Vallejo for supplemental law enforcement services beginning January 1, 2026.

 

In order to fulfill contractual obligations, the Sheriff’s Office is requesting two limited-term Sergeant Sheriff positions for the duration of the agreement and the approval of an Appropriation Transfer Request (ATR) to establish and appropriate a budget for FY2025/26.

 

FINANCIAL IMPACT:

 

The proposed ATR of $5,369,815 includes start-up and implementation costs, salaries, benefits, and operating expenses for 17.0 FTEs (1.0 FTE Lieutenant-Sheriff, 2.0 FTE Sergeant-Sheriffs (Limited-Term Project), 12.0 FTE Deputy-Sheriffs, and 2.0 FTE Public Safety Dispatchers) from January 1, 2026 through June 30, 2026. These costs also include fixed asset purchases for the safety equipment, radios, and supplies plus a transfer out to Fleet for the purchases and outfitting of eight (8) patrol vehicles dedicated to Vallejo’s supplemental law enforcement services. The contract also funds a respective portion of administrative overhead costs of the Sheriff’s office, resulting in a reduction in the General Fund contribution to the Sheriff.

 

The Sheriff’s FY2025/26 budget lacks sufficient appropriations to fund these unanticipated services from January through June 2026; therefore, an Appropriation Transfer Request of $5,369,815 is needed to cover six months of operating costs plus the start-up costs.

 

Appropriations for the remaining six months of the service contract, for the period of July 1, 2026 through December 31, 2026 will be submitted in the Sheriff’s FY2026/27 Requested Budget.

 

 ALTERNATIVES:

 

The Board of Supervisors could choose not to approve these actions, however, this is not recommended as it would prevent the Sheriff’s Office from fulfilling its obligations under the approved agreement.

 

OTHER AGENCY INVOLVEMENT:

 

County Counsel and the County Administrator’s Office have been integral throughout the process and Human Resources has prepared the resolution to amend the List of Numbers and Classification of Positions.
