DEPARTMENTAL RECOMMENDATION:

 

The Department of General Services recommends that the Board of Supervisors approve an Appropriation Transfer Request (ATR) of $3,800,000 in FY2024/25 appropriations from the Justice Center Detention Facility (JCDF) Sanitary Sewer project (BU 1993) to the Fairfield Justice Center Detention Facility (JCDF) Housing Cell Improvement project (BU 1745) to consolidate cell improvement and sanitary sewer repair work within a single capital budget (4/5 vote required).

 

SUMMARY/DISCUSSION:

 

The recommended ATR will facilitate the consolidation of existing funding between two existing projects in the Justice Center Detention Facility (JCDF).

 

The JCDF Housing Cell Improvement project was previously approved by the Board of Supervisors and includes total funding of $3,641,537. Shortly after the start of construction, unanticipated cellblock sanitary sewer line & shower drain failures were discovered. Critical repairs to these sanitary sewer lines are needed to maintain sanitary conditions, allow uninterrupted construction to progress, and for the facility to operate.

 

To address the necessary sewer and shower drain line repairs, General Services expanded an existing Board approved sewer project which was originally intended for repair of underground sewer lines funded at $831,275. On June 20, 2024, the Board approved an additional $3,320,000 in new funding for these repairs under the JCDF Sanitary Sewer project (sewer project) with approval of the FY2024/25 Supplemental Budget, increasing the total sewer project budget to $4,151,275.

 

Whereas funding for the sewer project was originally intended for repair of underground sewer lines, a July 2024 technical assessment indicated their condition is adequate to allow their repair to be deferred, and for more urgent repairs to above-grade cellblocks to proceed with priority. Funds not expended on the more urgent upper-level repairs will remain available for repair of underground lines. Therefore, it is recommended that the Board approve an ATR transferring $3,800,000 of the existing funding from the Sewer Project into the Housing Cell Improvement project. Bringing the combined Housing Cell Improvement Project total project funding to $7,441,537.

 

Cellblock sanitary plumbing repairs will be combined with cell improvement work currently managed by Gilbane Building Company via Change Order. Consolidating the work will allow construction efforts to proceed without further delay under unified oversight of safety, phasing, site access, and coordination of construction disciplines within the occupied detention environment.

 

FINANCIAL IMPACT:

 

Through past actions, the Board has approved $3,641,537 for the JCDF Housing Cell Improvement project and $4,151,275 for the JCDF Sanitary Sewer project. Transferring $3,800,000 from the Sanitary Sewer project into the Housing Cell Improvement project will increase the approved Housing Cell Improvement budget to $7,441,537 to address both scopes of work (Attachment A). The estimated cost of cellblock sewer & shower drain repairs is $3,671,785, plus $38,000 for staff time and a contingency of $90,215, totaling $3,800,000 in BU 1745 for the urgent repairs, with remaining funding in BU 1993 of $351,275 reserved for future underground or related sewer repairs at the JCDF. No additional project funding is being requested at this time.

 

ALTERNATIVES:

 

The Board could elect not to approve the ATR and/or direct staff to perform urgent plumbing repairs separately under the JCDF Sanitary Sewer project. These actions are not recommended because they would result in delays in urgent repairs and potential additional project cost.

 

OTHER AGENCY INVOLVEMENT:

 

General Services has coordinated with the representatives of the Sheriff’s Office to develop funding priority recommendations for the project. County Counsel has been consulted regarding contractual matters. The project is overseen by a Steering Committee composed of senior and executive management from primary stakeholders including the Sheriff’s Office, Resource Management Department and County Administrator’s Office.
