DEPARTMENTAL RECOMMENDATION:
The Sheriff recommends that the Board of Supervisors:
1. Approve a revenue agreement for up to $400,000 with the County of Shasta to provide housing and associated services for Shasta County adult sentenced incarcerated persons housed in Solano County Adult Detention Facilities for the period October 1, 2025 through June 30, 2028;
2. Delegate authority to the County Administrator to execute the agreement and any subsequent amendments, with concurrence from County Counsel, up to an annual aggregate of $74,999; and
3. Authorize the Sheriff, Undersheriff, and Director of Administrative Services to sign any amendments that and are technical or administrative in nature.
SUMMARY/ DISCUSSION:
California Penal Code §4115.5 allows for local law enforcement jurisdictions to contract for inmate housing with other jurisdictions. The Solano County Sheriff is responsible for the operations of the Solano jail facilities and efficient scheduling of staff resources and has the responsibility to determine available capacity above the County of Solano immediate needs to assist other jurisdictions with housing needs.
Shasta County Sheriff’s Office (Shasta SO) has scheduled repairs and improvements to their jail facilities over the next two years and has approached the Solano County Sheriff’s Office (Solano SO) about temporarily housing Shasta County adult sentenced inmates (Incarcerated Persons) to relieve potential overcrowding. Although the Solano SO has experienced staffing shortages, the Solano SO has been filling Correctional Officer positions and believes Solano County can accommodate Shasta County’s housing request as bed space is available at both the Claybank Detention Facility (CDF) and the Justice Center Detention Facility (JCDF).
The Solano SO presented a daily bed rate proposal to the Shasta SO which has been accepted and incorporated into the proposed agreement. The proposed agreement allows for housing the Shasta Incarcerated Persons with Solano’s inmates at the CDF unless their classification requires placement at the JCDF. Shasta County will retain legal custody over these Incarcerated Persons while Solano County will exercise physical custody of the Incarcerated Persons. Should the number of Solano County inmates rise, creating overcrowding or other operational issues, the proposed agreement allows for the Solano County Sheriff to return Shasta’s Incarcerated Persons to Shasta County. The Solano SO is interested in assisting Shasta SO with its housing needs and is requesting the Board approve the proposed agreement.
FINANCING:
Revenue for the 33-month agreement with Shasta County is estimated up to $400,000. The revenue will offset the added jail operating costs for staffing, meals, facility maintenance, inmate programming, jail support, and correctional healthcare services. The Solano SO’s FY2025/26 Working Budget has sufficient appropriations to cover the expenditures to house Shasta’s Incarcerated Persons as the Solano average daily population has been lower than expected. Therefore, Board action will not impact the County General Fund.
The Solano SO will include sufficient appropriations and offsetting revenue in its FY2026/27 and FY2027/28 Requested Budgets to house Shasta’s Incarcerated Persons and to meet the obligations of the agreement.
The costs associated with preparing the agenda item are nominal and absorbed by the department’s FY2025/26 Working Budget.
ALTERNATIVES:
The Board may choose not to approve the agreement; however, this alternative is not recommended as non-approval would not allow the Solano SO to assist a neighboring county and would require Shasta County to seek temporary housing elsewhere.
OTHER AGENCY INVOLVEMENT:
Shasta SO obtained their Board’s approval and negotiated the proposed agreement with Solano SO. Solano County Counsel and Shasta County Counsel have reviewed and approved the agreement as to form.
