DEPARTMENTAL RECOMMENDATION:
The Department of Resource Management recommends the Board of Supervisors direct staff to formally submit a request to the Fairfield-Suisun Sewer District (FSSD) to:
1. Consider allowing a sewer connection for the property at 2280 Rockville Road; and
2. If the connection is approved by FSSD, delegate authority to the County Administrator to take all steps necessary to effectuate such connection including execution of an amendment to the 2003 “Agreement to Provide Disposal of Sewage” and application to Solano LAFCO to allow such connection.
SUMMARY:
In 2003, the County and the Fairfield-Suisun Sewer District (FSSD) entered into an Agreement to Provide Disposal of Sewage (“Agreement”) in the areas of Suisun Valley Road and Old Cordelia. In 2004, that Agreement was amended to allow sewer service connections to separate legal parcels in existence as of January 5, 2004 which were adjacent to existing sewer collections lines as identified by the Local Agency Formation Commission (LAFCO). County staff have been contacted by the property owner of 2280 Rockville Road requesting permission to establish a sewer connection to FSSD’s system due to a failing septic system. Should the Board approve the request, staff will make a formal request of FSSD which require a second amendment to the Agreement.
FINANCIAL IMPACT:
The costs associated with developing this agenda item is absorbed by the Department’s FY2024/25 Working Budget.
DISCUSSION:
On May 13, 2003, the County entered into an agreement with FSSD to provide sewer service in the area of Suisun Valley Road and Old Cordelia to recognize parcels that were receiving sewer service prior to March 1, 2002 and to identify developed parcels that would be eligible to receive sewer service upon a determination that their existing septic systems had failed. (Attachment A). Per the original agreement, 2280 Rockville Road (“subject parcel”) was deemed eligible to receive FSSD sanitary sewer service upon a finding of sewage-related health hazard by the Solano County Public Health Officer without further action by this Board or the District. However, the Agreement was amended in 2004 to eliminate any existing parcels from eligibility to receive sanitary sewer service unless such parcels were directly adjacent to sewer collection lines which included the subject parcel (Attachment B).
Therefore, while the subject parcel is not guaranteed a connection to FSSD’s system, it may still be allowed to connect if there is an existing or impending threat to health safety as determined by the County Public Health Officer and both the County and the District agree on a case-by-case basis. Such agreement would be subject to final approval by LAFCO under Government Code §56133(c).
The County Public Health Officer has determined that there is an existing threat (Attachment C). As a result, staff is recommending that the Board direct staff to formally submit a request to FSSD to allow this parcel to connect and if approved by FSSD, authorize the County Administrator to execute an amendment to the Agreement and to jointly submit an application to LAFCO to approve the connection.
ALTERNATIVES:
The Board could choose not to approve this request; however, that is not recommended since the County Public Health Officer has determined that there is an existing public health threat due to the failing septic system.
OTHER AGENCY INVOLVEMENT:
The County Public Health Officer has confirmed the existing public health threat due to the failing septic system. FSSD has been approached with this request and advised that your Board needs to approve the connection.
