DEPARTMENTAL RECOMMENDATION:
The Department of Resource Management recommends that the Board of Supervisors adopt a resolution accepting the dedication of two Public Roadway Easements, approximately 20,934 square feet (0.48 acres) for Right-of-Way purposes along Elizabeth Road and De Mello Road, north of Midway Road, for Minor Subdivision MS-22-04 (Griffin).
SUMMARY:
Minor Subdivision MS-22-04 creates two parcels, 5.02 acres and 4.85 acres each, within the Rural Residential ‘RR-2.5’ Zoning District. Parcel One fronts Elizabeth Road (County Road No. 3890) and Parcel Two fronts De Mello Road (County Road No. 3910) approximately 0.5 miles north of the City of Vacaville in the unincorporated area of Solano County (Attachment A - Parcel Map). The Tentative Map was conditionally approved by the Zoning Administrator on August 3, 2023. Condition number 5 of the conditions of approval for Minor Subdivision MS-22-04 require the subdivider dedicate a Public Roadway Easement for right-of-way purposes to achieve an ultimate halfwidth of 30-feet from the centerline of the existing right-of-way.
Parcel One dedicates a 30-foot wide Public Roadway Easement along the easterly frontage of Elizabeth Road (approximately 481-feet in length) and Parcel Two dedicates a 15-foot wide Public Roadway Easement along the westerly frontage of De Mello Road (approximately 433-feet in length). The dedication of both Public Roadway Easements satisfies the current right-of-way half-width requirements of the Solano County Road System as set forth in the Solano County Road Improvement Standards and Land Development Requirements.
This offer of dedication is in accordance with Chapter 26 of the Solano County Code and adoption of the resolution (Attachment B - Resolution) will result in the dedication being accepted and recorded with the Parcel Map, with the County Recorder’s Office.
FINANCIAL IMPACT:
The existing maintenance of Elizabeth Road and De Mello Road falls under the Road Fund; therefore, accepting these public roadway dedications has no impact to the General Fund. The costs associated with preparing this agenda item are nominal and absorbed by the Department’s FY2024/25 Working Budget.
DISCUSSION:
Offers of dedication through the subdivision process are vital to ensure the proper width of public right-of-way in accordance with the Solano County Road Improvement Standards and Land Development Requirements. The additional right-of-way widths provide for safety enhancements and improvement opportunities for the County’s Road System.
Pursuant to Solano County Code section 26-104(b), the County Surveyor has approved the Parcel Map pending acceptance of the offer of dedication by the Board of Supervisors. Solano County Code section 26-133.6 requires all offers of public dedication on a Parcel Map be formally accepted (or rejected) by the Board of Supervisors prior to the filing of the Parcel Map.
ALTERNATIVES:
The Board of Supervisors may choose to reject the offers of dedication of Public Roadway Easements for right-of-way purposes, and instead purchase the property in the future if it were needed for road purposes. This is not recommended, as dedications for road purposes are a requirement of County policies contained in Chapter 26 of the Solano County Code. These policies are intended to mitigate the impacts of new development on the County Road System.
OTHER AGENCY INVOLVEMENT:
None.
