DEPARTMENTAL RECOMMENDATION:
The Sheriff recommends that the Board of Supervisors rescind Resolution No. 2018-243 regarding the Sheriff's boating safety programs and adopt an amended resolution adding State mandated language specifying that not less than 100 percent of the amount received by the County in FY2019/20 from personal property taxes on vessels will be expended solely on boating safety programs.
SUMMARY/DISCUSSION:
On December 11, 2018 the Board-approved Resolution No. 2018-243 approving participation in the FY2019/20 Boating Safety and Enforcement (BSE) Financial Aid Program administered by the California Department of Parks and Recreation, Division of Boating and Waterways (DBW). Since our submission, the DBW has issued letters to applicants requiring additional language pursuant to Harbors and Navigation Code Section 663.7 be included in all Board-approved resolutions. The added language reflects a technical correction to the original resolution certifying that the County will expend for boating safety programs during the year of participation not less than an amount equal to 100 percent of the amount received by the County from personal property taxes on vessels. Although this language was not included in prior annual resolutions, the County Auditor-Controller certified an estimated personal property tax amount for inclusion in the County's application.
