DEPARTMENTAL RECOMMENDATION:

The Department of Agriculture/Weights and Measures recommends that the Board adopt the ordinance to amend Chapter 2.2 of the Solano County Code adding Section 2.2-70 relating to use of noise making devices for crop protection in the unincorporated areas of the county.

SUMMARY:

At its meeting on June 23, 2015, the Board of Supervisors introduced an ordinance amending Chapter 2.2 of the Solano County Code to add section 2.2-70 relating to the use of noise making devices for crop protection in the unincorporated areas of the county. If adopted, the ordinance will become effective on August 28, 2015.

FINANCIAL IMPACT:

The cost of preparing this report is borne by the Department of Agriculture/Weights and Measures.

DISCUSSION:

Use of noise making devices is currently allowed under Chapter 2.2 of the Solano County Code. There are currently no limitations for use on these devices in the ordinance. This amendment to the ordinance is designed to allow for growers to continue appropriate use practices for crop protection, while recognizing that inappropriate use constitutes a nuisance. This ordinance would also provide the Agricultural Commissioner and area peace officers the authority to issue a violation to the operator of property if the noise device was operated in conflict with the ordinance.

ALTERNATIVES:

The Board of Supervisors can choose not to adopt the ordinance; however, this is not recommended by the Department. Similar ordinances have been enacted in other counties to minimize agriculture and urban interface issues surrounding the use of such devices.
