DEPARTMENTAL RECOMMENDATION:

 

It is recommended that the Board of Supervisors approve the appointment of Elizabeth Miles as a director of the Rural North Vacaville Water District (“District”) with a term to expire on December 3, 2021.

 

SUMMARY/DISCUSSION:

 

The Uniform District Election Law (“UDEL”) establishes a body of election laws to be used by various special districts throughout the State to govern the election of officers.  UDEL applies to the election of directors of water districts.  The county registrar of voters is the election official.

 

If the number of persons who have filed a declaration of candidacy for director does not exceed the number of directors to be elected, no election is held. The election official submits a certificate of these facts to the board of supervisors and requests that the board appoint those who have filed valid declarations of candidacy.

 

The term of two directors of the District will expire on December 1, 2017.  The District scheduled a mail ballot election for August 29, 2017 to fill the two positions.  The Registrar of Voters received only the declaration of candidacy of Elizabeth Miles, which the Registrar certified as legally sufficient, and he received no petition signed by 50 voters in the District requesting that a District Election be held.  As a result, the Registrar neither received the requisite number of candidates to participate in nor a petition to hold the mail ballot election.

 

Accordingly, the Registrar requests that the Board of Supervisors appoint the declared candidate, Elizabeth Miles, as a director for a term to expire on December 3, 2021.
