DEPARTMENTAL RECOMMENDATION:

It is recommended that the Board of Supervisors adopt a resolution authorizing an exception to the 180-day wait period for the hiring of James W. Laughlin as an extra help retired annuitant.

SUMMARY/DISCUSSION:

In January 2013, the Public Employees' Pension Reform Act (PEPRA) went into effect and made substantial changes to the public employee pension laws in California. One such change prohibits retired annuitants from returning to work for a CalPERS employer for a period of at least 180 days from the date of retirement unless the governing body adopts a resolution to waive this time. This exception allows the employer to hire a retired annuitant immediately based on the County's requirement for that employee's specialized skills.

On November 24, 2023, James ("Jim") W. Laughlin retired from the County with over 34 years of land use experience as a Deputy County Counsel V. During this time, Jim has developed a specialized body of knowledge that is needed to assist on a few pending litigation matters. In addition, the County has been contacted by California Forever (Flannery Associates) of the potential submission of a General Plan Amendment that would include zoning changes for a new city in the County. Given the tight timeline to review any such proposal before the matter is potentially placed on the local ballot, it is not possible to wait the 180 days required under PEPRA.

Though Mr. Laughlin is looking forward to retirement, he has agreed to come back and assist on a part-time basis as needed on a few pending litigation matters and advise as necessary on California Forever's potential General Plan Amendment.
