DEPARTMENTAL RECOMMENDATION:

The Department of Resource Management recommends that the Board of Supervisors approve the reappointment of Henry N. Kuechler IV as Director, Division 3 of the North Delta Water Agency to hold office until noon on December 7, 2029.

SUMMARY/DISCUSSION:

The Uniform District Election Law (UDEL) establishes a body of election laws used by various special districts throughout the State to govern the election of officers. UDEL applies to the election of the board of directors of a water agency, which is a landowner voting district and is applicable to elections for the North Delta Water Agency.

Under UDEL, if the number of persons who have filed a declaration of candidacy for director does not exceed the number of directors to be elected and if the election official is not presented with a petition signed by 10 percent or more of the voters requesting a general district election, no election is held. The officer conducting the election submits a certificate of these facts to the Board of Supervisors and requests that the board appoint those who have filed declarations of candidacy.

Adam Borchard, the North Delta Water Agency's Manager, received one declaration of candidacy from a qualified landowner for the office of Director, Division 3 and did not receive a petition requesting a general district election. Since Division 3 is in Solano County, the Agency requests that the Solano County Board of Supervisors reappoint the declared qualified candidate, Henry N. Kuechler IV, as Director, Division 3, to hold office until noon on December 7, 2029.
