DEPARTMENTAL RECOMMENDATION:

Supervisor Monica Brown recommends adopting a resolution opposing the adoption of a proposed U.S. Department of Housing and Urban Development rule to prohibit the use of public housing and/or federal housing subsidies by families with mixed immigration status.

SUMMARY/DISCUSSION:

The proposed rule by the U.S. Department of Housing and Urban Development (HUD) published in a federal Notice of Proposed Rulemaking on May 10 would change current federal law to prohibit the use of federal public housing and/or federal housing subsidies for families with persons who are both eligible and ineligible based on immigration status for federal public housing and/or federal housing subsidies. Current law allows families with mixed immigration status to use federal public housing and/or federal housing subsidies. Families with mixed-immigration status who receive federal money for housing have the subsidy reduced for persons who are ineligible based on immigration status so that those who are ineligible are not subsidized. Under the proposal families with members who are deemed ineligible will be evicted from subsidized housing within 18 months. Currently, there are five families in the unincorporated area of Solano County, out of a total of 243 households utilizing vouchers, that would likely be impacted by the proposed rule.

Comments on the proposed rule are due by July 9, 2019 and the County's Legislative Committee will not meet prior to that date; therefore, District 2 is requesting the Board adopt a resolution opposing the rule at this time.
