DEPARTMENTAL RECOMMENDATION:
It is recommended that the Board adopt an ordinance amending Chapter 11, article IX of the Solano County Code, relating to revenue.
SUMMARY/DISCUSSION:
We need to maintain a current Solano County Code to reflect changes in the law and in conditions governed by the county's body of laws.
A prime example for amending the code is the four current sections in Chapter 11, article 9. The jail incarceration fee and the criminal justice administration fee have been superseded by the enactment of Government Code section 29551, subdivision (b). If the State Controller allocates $35 million for local detention facilities, a county is authorized to charge a jail access fee to a local agency that exceeds the agency's three-year average number of non-felony bookings for specified crimes.
Similarly, the property tax administrative cost recovery provision which cites Revenue and Taxation Code section 97 as authority has been superseded by the Revenue and Taxation Code section 95.3 and is determined administratively. Section 95.3 authorizes counties to collect from each appropriate taxing jurisdiction that jurisdiction's share of the cost of assessing, collecting and apportioning property taxes.
Finally, with regards to pari-mutuel wagering, because the county no longer conducts a racing meet, the reference to Business and Professions Code section 19610.3 is inapplicable and only the deductions from satellite wagering under Business and Professions Code section 19610.4 apply.
FINANCIAL IMPACT:
There is no net impact on the General Fund.
