DEPARTMENTAL RECOMMENDATION:
 
It is recommended that the Board consider:
 
1.      Appointing Jon A. Blegen to the public-at-large position on the City of Rio Vista Redevelopment Agency Oversight Board.
 
2.      Appointing one alternate for the public-at-large position on each of the Redevelopment Agency Oversight Boards in the cities of Dixon, Rio Vista, Suisun City, and Vallejo.
 
SUMMARY/DISCUSSION:
 
On December 29, 2011 the California Supreme Court upheld Assembly Bill 1X 26 (Dissolution Act), which dissolved all redevelopment agencies as of February 1, 2012.  The Dissolution Act provides for successor agencies to wind down the activities of the former redevelopment agencies.  Successor agencies are supervised by oversight boards comprised of seven members appointed by various governmental agencies.  The Board of Supervisors is responsible for choosing two of the members of each oversight board - one of whom has to be a member of the public.
 
At its February 7, 2011 meeting, the Board began the process of filling its two designated positions on each of the oversight boards by appointing certain Board Members to the oversight boards and directed staff to invite members of the public to apply for the remaining slots.  On February 28, 2011, the Board appointed public-at-large members to all oversight boards, with the exception of Rio Vista.  The Board also appointed alternates to two of the oversight boards for Fairfield and Vacaville, leaving unfilled the appointments for Dixon, Rio Visa, Suisun City and Vallejo. The results of these appointments are summarized in the attached table (Attachment A).
 
Also at its February 28 meeting, the Board asked staff to return with a recommendation on how many alternates should be appointed and for what position(s) (Board members and/or public-at-large members).  While the Dissolution Act is silent on the appointment of alternates, staff is recommending the appointment of one alternate to each oversight board for the public-at-large position to ensure that the County's interests remain fully represented should one of its regular appointees be unable to make a meeting. It is the County Counsel's position that the appointment of alternates is valid. However, staff does not recommend the appointment of an alternate for Board members, but leaves this to the discretion of the Board.
 
Supervisor Reagan and staff are recommending the appointment of Jon A. Blegen as public-at-large member to the Rio Vista Redevelopment Agency Oversight Board.  Mr. Blegen had been the Rio Vista city attorney for a number of years and presently serves as the attorney for the Solano County Mosquito Abatement District. The Board is also asked to appoint one alternate to the four remaining oversight boards - Dixon, Rio Visa, Suisun City and Vallejo.  
 
FINANCIAL IMPACT:
 
The costs of further outreach to Rio Vista and preparing this staff report are absorbed within the budgets of the County Administrator, County Counsel and Clerk of the Board.  There will be no additional cost or impact to the General Fund.
 
ALTERNATIVES:
 
The Board has three primary alternatives regarding this agenda item:
 
1.      The Board could choose not to appoint Mr. Blegen.  This is not recommended as he is highly qualified and he has been nominated by Supervisor Reagan; his non-appointment would necessitate further public outreach and returning to the Board at a later date, further delaying filling this County-appointed seat on the Rio Vista oversight board.
 
2.      The Board could also choose not to appoint an alternate to each oversight board.  This is not recommended for the reason stated above.
 
3.      The Board could also choose to appoint more than one alternate.  This is not recommended since the number is constrained by the number of interested individuals seeking appointment to the public-at-large position on each oversight board, which to-date has been limited.
 
OTHER AGENCY INVOLVEMENT:
 
The County Counsel and the County Administrator's Office have worked collaboratively on this item.
