DEPARTMENTAL RECOMMENDATION:

 

It is recommended that the Board select a current board member, an alternate board member and a member of the public to serve on the Solano County Consolidated Oversight Board (Consolidated Board), pursuant to the state law that dissolved redevelopment agencies (RDA). Staff is seeking direction on the criteria and selection process for the public member appointment and also like to confirm with the Board of Supervisors that the County’s board chambers be used for the consolidated oversight board meetings and that these meetings be video recorded and posted to the county website.

 

SUMMARY:

 

It is recommended that the Board select a current board member and an alternate board member to serve on the Consolidated Board pursuant to the state law that dissolved redevelopment agencies (RDA).  The current six Successor Agency Oversight Boards in Vallejo, Fairfield, Suisun, Vacaville, Dixon and Rio Vista are prescribed by state law to expire and consolidate into one oversight board effective July 1, 2018.  The Auditor-Controller will staff the Consolidated Board that will be responsible to dispose of any remaining Successor Agency/RDA properties and to make payments for remaining debt service/other financial obligations approved by the State of California Department of Finance. The Consolidated Board will consist of seven members represented by: county, city, special district, school, community college, public, and a successor agency employee. 

 

Staff would also like to confirm with the Board of Supervisors that the county board chambers will be used for the Consolidated Board’s meetings and these meetings will be video recorded and posted to the county website. Currently, the Successor Agency Oversight Board meetings in Vallejo, Vacaville, Fairfield and Dixon are video recorded and posted to their respective websites.

 

The Board of Supervisors is also required by state law to select a public member (and alternate if the Board chooses this option) to the Consolidated Board. Staff is seeking direction on the criteria and selection process for the public member appointment.

 

FINANCIAL IMPACT:

 

The costs of preparing the staff report and potential recruitment efforts for a public member will be recovered from the Redevelopment Property Tax Trust Fund.

 

DISCUSSION:

 

On December 29, 2011, the California Supreme Court upheld Assembly Bill AB1X 26 (“Dissolution Act”), which dissolved all redevelopment agencies as of February 1, 2012. On February 7 and 28, 2012, the Board of Supervisors approved both board member appointments and public member appointments to the six Successor Agency Oversight Boards (Oversight Boards) in Vallejo, Fairfield, Suisun, Vacaville, Dixon and Rio Vista. Referencing the current 2018 Board of Supervisors Appointment List (attached), Supervisor Vasquez serves on the Dixon Oversight Board, Supervisor Spering serves on both the Fairfield and Suisun Oversight Boards, Supervisor Thomson serves on the Vacaville and Rio Vista Oversight Boards, and Supervisor Hannigan serves on the Vallejo Oversight Board.

 

Effective July 1, 2018, all six Oversight Boards are required by Health and Safety Code § 34179(j) to cease and consolidate into one consolidated oversight board for the county, requiring only one county board member appointment.  The Board of Supervisors has the option of appointing an alternative if the primary appointment is unavailable to attend the meetings.  The responsibility of the Consolidated Board is to continue to administer the Long Range Property Management Plan (LRPMP) of each successor agency and to ensure that all remaining debt and financial obligations are paid by the Redevelopment Property Tax Trust Fund created for each dissolved RDA.

 

The Auditor-Controller has prepared a memorandum dated February 16, 2018 that outlines the membership criteria for the Consolidated Board pursuant to Health and Safety Code § 34179(j) and has provided information regarding the number of properties to be sold and debt obligations by successor agency.  There is no compensation for members that serve on the Consolidated Board.

 

The Board of Supervisors is also required by state law to select a public member (and alternate if the Board chooses this option) to the consolidated oversight board. Staff is seeking direction on the criteria and selection process for the public member appointment.

 

Options for appointing the public member:

 

1)                     The Board may choose to appoint an existing public member assigned to one of the successor agency oversight boards.  The current public member appointments include Debbie Muhl (Dixon), Anthony Russo-primary, Chuck Timm-alternate (Fairfield), Jon Blegan (Rio Vista), Dilenna Harris-primary, Ralph Cotton-alternate (Vacaville), and Gary Truelsen (Vallejo).

 

2)                     The Board may choose to open a selection process and create a sub-committee of the Board to interview interested individuals, including the current public member appointees.  The sub-committee would then recommend to the Board of Supervisors the appointment(s) for consideration and approval.

ALTERNATIVES:

 

The Board could provide additional direction to staff for the appointment process.  It is recommended that the Board act to appoint a county board member and public member prior to July 1, 2018.

The Auditor Controller and County Counsel have worked collaboratively on this item.
